CERTIFlED
Mr. Tom Dempsey
435 Kossow Road
Waukesha, WI 53186
Dear Mr. Dempsey:
The Department of Environmental Quality was notified of the September 28, 1995, traffic accident neat Bozeman,
Montana, that resulted in the release of approximately 125 gallons of diesel fuel from the saddle tank of a Hirsch
Trucking semi-truck. Placement of the diesel fuel in a position where it will eause pollution of state waters
constitutes a violation of the Montana Water Quality Act (75-50.605 MCA). September 28, 1995, I wu informed
that the local insurance adjuster for Hirsch Trucking was going to contact Greg Poncelot, of Montana Ready Mix,
to dispose of the diesel contaminated sand from the accident. October 3, 1995, I contacted Mr. Poncclot to verify
that the spill had been cleaned up. Mr. Poncelot indicated that he had. not been contacted to cleanup this site.
October 4, 1995, I contacted you to discuss cleanup at this site and you indicated you thought the spill had been
cleaned up. October 16, 1995, Mr. Poncelot informed me that Montana Ready Mix had cleaned up diesel
contaminated soils from the Hirsch Trucking traffic accident.
Prior to designating the Hirsch Trucking File inactive, the Department must be assured that adequate remediation
has been completed at this site. To verify that soils and ground water have been properly remediated, the
Department requires that Hirsch Trucking submit a status report by November 10, 1995, that describes the remedial
actions completed at the site, including all analytical results from soil and ground water sampling. The report must
verify that material contaminated by the spill wu removed and that state waters will not be contaminated. If
residual diesel contamination remains, the Department may require Hirsch Trucking to take additional remedial
actions.
Please contact me at (406) 444-5343, if you have any questions.
Sincerely,
Cvw4;1/'J V. j)e..M.a.;~

Fire Investigation, Supplemental Report
Investigator: Acting Captain Mike Hoey
Report Number: 950655
Bozeman Firefighters were dispatched to the Law and Justice building, 615 South 16th A venue to
investigate a vandalized car. A 1980 Oldsmobile, Brome was found with the owner, Marjorie
Paisley, 105 West Main, #6B, Ph. 587-3342 and Police Officer Tammy Eckhardt. I was asked to
investigate a fire in the right rear passenger car door. I was told that the fire was discover by Ms
Paisley earlier that same day. She said: she had locked the car the night before but the car was
open and had burned when she went to drive it. Ms Paisley said her car had been vandalized 5
times before.
The car door was photographed by Bozeman Fire Department Fire Marshal Chuck Winn. Mr
Wino arrived a short time after the interview ofMs Paisley began. I removed all burned glass and
debris from the interior of the car. Nothing ofimportance was noted except that the glass
fragments indicated the fire had originated on the inside of the car. The back seat of the car was
removed. Nothing of importance was noted. The door assembly was removed and the interior of
the automatic door lock, electric window and other components were viewed. The fire originated
approximately 7 inches from the door frame in an area that had no heat source. The fire was
generally insignificant in size. Smoke spread through-out the interior of the car. No reason for
the fire could be found. No electrical cause for the fire could be found. The fire was listed as
suspicious and most likely an act of vandalism. Investigation is continuing.

Acting Captain
