Box 1230 Bozeman, Montana RELEASE AND RECONVEYANCE OF EASEMENTS The City of Bozeman, 411 E. Main, Bozeman, MT 59715, a Municipal Corporation of the State of Montana hereinafter referred to as "GRANTOR," does hereby release and reconvey the temporary 900 turnaround easements on Lot 1 of Block 30, Harvest Creek Subdivision Phase 7, Lots 1 and 8 of Block 31, Harvest Creek subdivision Phases 6 and 7, and Lot 8 of Block 32, Harvest Creek Subdivision Phase 6, all in the City of Bozeman, Gallatin County, Montana, unto Gateway Partners Limited Partnership, of 1201 Peachtree Street, Atlanta, Georgia 30361, in accordance with the provisions set forth below. The plats for Phases 6 and 7 of Harvest Creek Subdivision, J-349 and J-358, respectively, provide that there shall be temporary 900 turnaround easements on the lots described above, in order to provide appropriate access for emergency vehicles. In an accompanying Easement, the Grantee in this instrument has granted to the City of Bozeman an easement over an across certain lots within Harvest Creek Subdivision Phases 6 & 7 that will adequately provide turnarounds for emergency vehicles which are equal to or greater than the access originally shown on the plats co ! ~ ~ mt'J- ~ol .... THEREFORE, the Grantor does hereby release and reconvey to Gateway Limited 900 Partnership those Partners temporary turnaround easements, as well as any accompanying no-build restrictions for Lot 1 of Block 30, Harvest Creek Subdivision Phase 7, and Lot 8 of Block 32, Harvest Creek subdivision Phase 6, shown on the plats for Harvest Creek Subdi vision,_. Phases 6 and 7, Bozeman, Gallatin County, Montana, together with any right, title, or interest that the Grantor may have in the easements_ This document shall not affect or release any other easement shown on the plats for Harvest Creek Subdivision not specifically described herein, nor shall it modify or release any condition of subdivision approval not specifically described herein.
