COMMISSrON RESOLUTION NO. 3841
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, PROVIDING FOR THE ANNEXATION OF A CERTAIN CONTIGUOUS
TRACT OF LAND, HEREINAFTER DESCRIBED, TO THE CORPORATE LIMITS OF
THE CITY OF BOZEMAN AND THE EXTENSrON OF THE BOUNDARIES OF THE
CITY OF BOZEMAN SO AS TO INCLUDE SAID CONTIGUOUS TRACT.
WHEREAS, the City of Bozeman received a petition for annexation in accordance with Title 7,
Chapter 2, Part 46 MCA, from Snowload LLC, owner of the tract of land, requesting the City Commission
to extend the boundaries of the City of Bozeman so as to include a certain contiguous tract of land legally
described as the second tract of land described in Document No. 2012272, Records of Gallatin County,
and being located in the E Y:r SE %, Section 32, T1 S, R6E, PMM, Gallatin County, Montana, located 3700
feet east of the intersection of Bridger Canyon Drive and Story Mill Road; and
WHEREAS, an annexation staff report has been prepared in accordance with the Commission's
goals and policies for annexation and was presented to the Commission on August 16, 2004; and
WHEREAS, on September 27, 2004, the Commission authorized and directed staff, upon
satisfaction by the applicant of the terms of approval, to prepare the necessary documents to proceed with
the annexation of this tract; and
WHEREAS, the provision of available services, including, but not limited to, easements, water
rights or cash in lieu, to said contiguous tract is the subject of a written agreement between the City and
Snowload LLC, record owners of the tract; and
WHEREAS, the Bozeman City Commission hereby finds that the annexation of this contiguous
tract is in the best interests of the City of Bozeman and the inhabitants thereof and of the inhabitants of
the contiguous tract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana:
Section 1
That it is hereby declared that, pursuant to Title 7, Chapter 2, Part 46, M.C.A., the following-
described property, which is contiguous to the municipal boundaries of the City of Bozeman, be annexed
to the City of Bozeman and that the boundaries of said City shall be extended so as to embrace and
include such 37.743 acres of land, to wit:
A tract of land being the second tract described in Document No. 2012272, Records
of Gallatin County, situated In the E1/2SE1I4 Section 32, T1S, R6E, P.M.M., Gallatin ~v
County, Montana, and being further described as follows:

Beginning at the 1/4 corner common to Sections 32 and 33 in said Township and
Range; thence along the section line between said Sections S01OS9'43"E a distance
of 707.93 feet to a point on the northerly right-of-way line of Montana Highway 86;
thence along said right-of-way line S49D3T40"W a distance of 42.31 feet,
S40006'1 O"W a distance of 133.07 feet, S49D37'40"W a distance of 805.33 feet, along
a curve to the right having radial bearing of N40023'55"W and a radius of 1 086.00 feet
a distance of 432.62 feet, 517021 '34"E a distance of 20.03 feet, and along a non-
tangent curve to the right having radial bearing of N17008'23"W and a radius of
1 066.00 feet a distance of 190.92 feet to a point on the E1/16 line of said Section 32,
said point also being on the east line of Lot 1 of Ed Vogel Subdivision No.1; thence
along said 1/161ine and the east line ofsaid Lot 1 N01 043'31 "W a distance of 1630.06
feet to the C-E 1/16 corner of said Section 32; thence along the E-W mid-section line
of said Section 32 S89049'43"E a distance of 1312.37 feet to the Point of Beginning.
Said tract contains 37.743 acres, more or less, along with and subject to all easements of record
or apparent on the ground.
Section 2
The effective date of this annexation is September 20, 2005.
Section 3

The annexation of the above-described tract is subject to the terms of the Agreement dated
September 6, 2005, by and between the City of Bozeman and Snowload LLC.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a
regular session thereof held on the 6th day of September 2005.
