5.3 Million Gallon Water Storage Reservoir
THIS AGREEMENT is made as of this /0 day of �Z , 2015,
between THE CITY OF BOZEMAN, a Municipal Corporation, Bozeman, Montana, herein referred
to as OWNER and Robert Peccia and Associates an Engineering Consulting Firm of Helena,
Montana, herein referred to as ENGINEER.
WHEREAS, the parties have entered into a Professional Services Agreement dated January 5,
2015, herein referred to as Original Agreement for professional engineering services; and
WHEREAS, the parties desire to further amend the provisions of this Agreement.
NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS
CONTAINED HEREIN, the parties agree as follows:
The conditions and provisions set forth in the attached EXHIBIT A-1 (Scope of Services) and
EXHIBIT B-1 (Fee Proposal) are hereby incorporated in and made part of this Agreement.
ARTICLE 1 - ENGINEERING SERVICES
1.1. The detailed description of the specific project components is described as follows:
This project is the engineering final design phase for the new 5.3 million gallon water storage
tank. Major work tasks include completion of the geotechnical investigation, design criteria
report and preliminary and final design phase services for the 5.3 million gallon water storage
reservoir and related items.
1.2. The scope of services under this contract is set forth in this agreement and the attached
EXHIBITS.
ARTICLE 4 - BASIC ENGINEERING SERVICES
The ENGINEER shall render professional Engineering Services as follows:
4.2 PRELIMINARY DESIGN PHASE
After acceptance of the pre -design report and receipt of written authorization to proceed with the
Preliminary Design Phase, ENGINEER shall:
4.2.1. In consultation with OWNER determine general scope, extent and character of the
Proj ect.
4.2.2. ENGINEER shall then prepare a Preliminary Design Report, preliminary plans and
specifications and a written description for the Project.
4.2.3. Preliminary Design Report: Specific items to be addressed in the design report will
include, but not be limited to:
4.2.3.1. Summary of construction requirements with appropriate drawings for
each task included in the project.
4.2.3.2. Plans —for rev" water and sewer-ei=viees for affeoted proper -ties
,a,,,ing eens+,.,,elie plan for keeping the existing water treatment plant in service
4.2.3.3. Summary geotechnical report for specific tasks, if needed.
4.2.3.4. Special design considerations for Project tasks with conditions not
covered in standard construction methods or specifications.
4.2.3.5. A traffic control plan for each project task, if necessary.
4.2.4. Design and Construction Survey: The ENGINEER shall conduct a design field survey
of the project areas, as necessary, for locating existing utilities (such as gas, power, telephone,
TV cables, water and sewer lines, irrigation facilities, fences, and approach driveways),
existing right-of-way and easements, and making measured drawings of or investigating
conditions of existing facilities (This work item was completed under the Pre -Design
Investigation Phase).
The ENGINEER shall provide suitable horizontal and vertical reference control points for the
construction phase.
4.2.5. Permits and Rights -of -Way: The ENGINEER shall obtain approved permits, licenses,
and/or easement agreements from private landowners and any other agencies or entities
requiring similar approvals prior to bidding. These approvals will be coordinated with the
OWNER and will be made on easement and permit documents approved by the OWNER.
Information and easement descriptions provided in the Basic Engineering Services will be
based on data available from design surveys and courthouse records.
4.2.6. Geotechnical Explorations and Anal The ENGINEER shall conduct such
geotechnical explorations and analysis as necessary for project design and bidding. A
geotechnical report will be prepared with recommendations relating to conditions pertinent to
the design and construction of the Project. Subsurface information will be obtained by
reviewing any existing geotechnical data available and using additional backhoe test pits and
soil borings as necessary.
The ENGINEER shall furnish copies of a geotechnical report as requested to OWNER for use
by OWNER and Contractors, and review the results of the report with Contractors in a pre-bid
meeting. The report is to be prepared for design purposes; ENGINEER will not be responsible
if it is used by others for other purposes.
4.2.7. Preliminary Plans and Specifications. Prepare preliminary construction plans and
specifications with information which addresses the special features of each project task.
4.2.8. Based on the information contained in the preliminary design documents, ENGINEER
will submit a revised opinion of probable Total Project Costs to the OWNER.
4.2.9. ENGINEER shall prepare and furnish complete paper and electronic copies of
preliminary bidding documents and design report as requested to OWNER and at the same time
furnish copies as directed by OWNER to agencies and/or parties having regulatory

responsibilities or direct financial participation in any part of the Project; provide any technical
criteria, written descriptions and design data necessary for securing permits or approval from
authorities having jurisdiction to review and approve the design, and assist owner in securing
such approvals; and review documents in person with OWNER and review authorities, and, if
necessary, conduct a plan -in -hand site review. All changes agreed to between ENGINEER
and OWNER will be noted in a memorandum from the ENGINEER to the OWNER and
incorporated into the final plans and specifications.
The Preliminary Design Phase will be completed and submitted within 120 calendar days following
written authorization from OWNER to ENGINEER to proceed with that phase of services.
4.3 FINAL DESIGN PHASE
After written authorization to proceed with the Final Design Phase, ENGINEER shall:
4.3.1. On the basis of the accepted Preliminary Design documents and the revised opinion of
probable Total Project Costs, prepare for incorporation in the Contract Documents final
drawings and Technical Specifications of sufficient detail to show the general scope, extent and
detailed character of the work to be furnished and performed by the Contractor(s) suitable for
use in the project bidding and construction.
4.3.2. Advise OWNER of any adjustments to the latest opinion of probable Total Project
Costs caused by changes in general scope, extent or character or design requirements of the
Project or Construction Costs. Furnish to OWNER a revised opinion of probable Total Project
Costs based on the Drawings and Specifications.
4.3.3. Prepare for review and approval by OWNER, its legal counsel and other advisors,
contract agreement forms, general conditions and supplementary conditions, and (where
appropriate) bid forms, invitations to bid and instructions to bidders, special provisions,
technical specifications, and standard drawings, and other related contract documents in
conformance with the latest edition of the Montana Public Works Standard Specifications
(MPWSS) and City of Bozeman Modifications to MPWSS adopted by the City of Bozeman.
4.3.4. Furnish OWNER six copies and an electronic copy of the Contract Documents
(including design drawings, specifications and contracts).
The Final Phase will be complete and submitted within 30 calendar days following written
authorization from OWNER to ENGINEER to proceed with that phase of services and following
approval of the preliminary plans and specifications by the Montana Department of Environmental
Quality.

ARTICLE 6 — COMPENSATION FOR ENGINEERING SERVICES
6.1 LUMP SUM AGREEMENT FOR BASIC SERVICES AND EXPENSES OF ENGINEER
6. 1.1 Payment. The OWNER shall for design phase services performed as Basic
Engineering Services under section 4.2 and 4.3 of this agreement pay a total sum in the amount
of $255,036.00 for such services.
6.1.2 Payment Schedule. Total cumulative payments for the design phase engineering
services (sections 4.1 through 4.4) shall not exceed the following ceilings:
$ 24 504.00 (10 % of design fee) until the Pre -design Investigation and
Preliminary Design Report have been submitted to the OWNER.
$ 127 518.00 (50% of design fee) until the Preliminary Plans
and Specifications have been submitted to the OWNER and review authorities.
$ 229,532 (90% of design fee) until the Final Plans and
Specifications have been submitted to the OWNER and review authorities.
$ 255 036.00 (100% of design fee) until the Final Plans and
Specifications have been reviewed and approved by the OWNER and review authorities.
6.1.3 General. Engineer shall submit monthly statements for services rendered. The
statements shall be based upon Engineer's estimate of the proportion of the total services
actually completed at the time of billing, subject to any limitations on Payments based on
completion of tasks or specific retainage requirements pursuant to the payment provisions of
the Agreement.
6.1.4 Reimbursable Expenses. Only those expenses specifically identified for payment
under section 6.2 of this Agreement are reimbursable. All other design related expenses are
included in the Lump Sum Payment for the Basic services (4.1 through 4.4) and are not
separately reimbursable. Additional Services specifically identified under the scope of design
services for payment under 6.1 are not separately reimbursable.
The attached EXHIBIT B-1 Fee Proposal assumes that only the 75 feet deep borehole required
for the geotechnical investigation will require casing advance with mud rotary drilling and that the
remaining four 40 feet deep boreholes can be completed with standard hollow stem auger equipment.
Except as specifically amended herein, the original agreement shall remain in full force and
effect and the Parties shall be bound by all terms and conditions therein.

Design Phase Services
1. Project Management and Meetings. This work item includes the following work elements:

bidding.
6. Subsurface Utility Work (to locate 30 -inch transmission main). The purpose of this work item is to locate
and determine the elevation of the 30 -inch transmission main on Sourdough and Nash roads to determine
the length of the main that will have to be lowered and to determine the location and elevation of the 30-

Proposed Scone of Services
Description of Project
The purpose of the pre -design geotechnical evaluation will be to characterize and evaluate subsurface soil
and groundwater conditions at the selected boring locations for the project. It will also assist us in
determining the necessary additional work needed for the design geotechnical report, if necessary.
It is our understanding, the City of Bozeman is considering a 5.3 million -gallon (MG) water tank. Actual
selection and sizing of the tank configuration is still in progress. The 5.3 MG tank would have an inside
diameter of about 163 feet and an interior water depth of approximately 35 feet. To avoid pumping,
consideration is being given to burying the tank 20 to 30 feet below the ground surface. We have
assumed some water lines will be necessary to and from the tank.
We have assumed we will be provided with a to -scale site plan showing the location of the proposed tanks
and nearby fixed features prior to the fieldwork. We have also assumed the boring locations will be
accessible to our truck -mounted drill rig, and no towing or snow removal services will be required.
Access delays due to circumstances beyond our control could result in additional charges. We have also
assumed our current insurance amounts are acceptable, and we can provide you with a certificate of
insurance.
Scope of Services
Borehole Staking. We request you stake the boring locations at least three days prior to our drill crew's
arrival on the site. We wHI assist in selecting the boring locations based on the selected tank size and
location_ Lathe should be set at each boring location and Have pink and blue ribbon tied near the top. In
pavement, the boring locations should be marked with spray paint and the lathe with ribbon offset. It
would be beneficial to mark the lathe with the boring number, survey the location, and provide us with the
ground surface elevations and GPS latitude -longitude coordinates. Our drill crew may have to alter the
boring Iocations depending on access issues or utility conflicts.
Soil Borings. We propose to provide five soil borings for the 53 MG tank: four around the perimeter,
90 degrees apart and one at the tank center. We propose to perform the tank center boring to a depth of
75 feet, and the remaining borings to 40 feet. Our firm has encountered auger refusal at depths ranging
from about 17 to 25 feet in the dense gravels on the site. Therefore, the deeper boring will be performed
with our casing advance system and mud rotary drilling technique to the termination depth. Because
these borings require water, they are weather dependent. The air temperature needs to be 35 degrees
Fahrenheit and rising. Therefore, there is a risk the borings may be delayed for several- months until
warmer weather.

For the remaining borings, hollow -stem auger will be used with a larger drill rig (Diedrich D-120) and we
will attempt to extend them to 40 feet, however, auger refusal could occur at shallower depths. We also
propose to complete two of the 40 -foot borings as piezometers to allow contractors and others to measure
groundwater levels in the tank area.
We also propose to perform two soil borings to a depth of 20 feet along the water line to and from the
tank(s). One of these borings will be completed as a piezometer.
We propose to conduct penetration tests in the borings to assist in evaluating bearing capacities of the
subsoils and to obtain representative samples for classification. The penetration tests will be conducted at
5 -foot intervals to the termination depths of the borings. A field engineer will be present while drilling to
visually classify and log the samples from the borings. Some tube samples may be taken for laboratory
strength and consolidation/swell testing. If groundwater is encountered, its depth will be recorded. Upon
completion, the borings not completed as piezometers will be backfilled with auger cuttings to the ground
surface.
For the piezometers, we are proposing to install 1 -inch Schedule 40 PVC pipe. We will install 20 -foot
screens in the 40 -foot piezometers, and a 10 -foot screen in the 20 -foot piezometer. Solid casing will then
be provided above the screen to approximately 2 1/2 feet above the ground surface. Sand backfill will be
provided to 2 feet above the screens, then a 2 -foot thick bentonite seal. Auger cuttings will then be used
as backfill to within about 3 feet of the surface, where sackrete will be used and a stovepipe cover to
protect the piezometer. A locking cap will be provided, however, no lock will be installed.
Laboratory Testing. The samples will be returned to our laboratory and visually classified and logged
by a geotechnical engineer. Some routine laboratory tests may be conducted to assist us in evaluating the
strength and compressibility of the soils. Although the laboratory testing could vary, we are proposing
the following.
• 75 moisture content tests
• Six classification (Atterberg limits and grain size) tests
• Three consolidation/swell tests
• Two moisture -density curves (Proctors)
• Four corrosion tests, including pH, resistivity and sulfates
Pre -Design Geotechnical Report. After the field and laboratory tests have been completed, the results
will be analyzed and discussed with you and/or your structural engineer. A geotechnical engineering
report will then be prepared. The report will address suitability of the soils to support the proposed
shallow -spread footings and tank deck (slab), allowable bearing capacity for spread footings,
improvements to footing and deck subgrades (if necessary), reuse of excavated material as backfill, and

recommendations for compaction. The report will also contain our recommendations regarding
International Building Code (IBC) site class, seismic induced wall pressures, simplified liquefaction
analysis, groundwater considerations, mapped spectral response accelerations S, and S1, and long period
transition period TL. The geotechnical report will be prepared on 11- by 17 -inch AutoCAD sheets
containing details of our recommendations. One electronic copy will be emailed to you followed by a
hard copy in the mail
Limitations of Pre -Design Geotechnical Report. We recommend performing a pre -design geotechnical
evaluation to obtain subsurface soil and groundwater information related to the site. Due to the critical
nature of the structures and depending on the conditions encountered, more thorough design geotechnical
evaluation could be required in the future. Geotechnical items not included in this pre -design
geotechnical evaluation, but could be necessary for the next phase, include the following.
• A site specific spectral response analysis (Site Class E or F).
• A 100 -foot deep boring.
• Detailed liquefaction analysis.
• Mitigation and identification of seismic hazards, if any.
• Shoring and dewatering designs for the excavations.
Additional Work. As previously mentioned, we are planning to use our Diedrich D-120 rig for the
work, but it could also encounter auger refusal prior to reaching the 40 -foot depth. Rather than breaking
equipment, it may be necessary to casing advance some of the perimeter tank borings as well. if this is
necessary, the additional cost will be $65 per foot, and we will contact you for authorization.
Utility Clearance. SK Geotechnical will contact the local utilities one -call number to notify the local
telephone, electric, gas, sewer, water, and cable TV companies to determine the location of underground
utilities. We request that you or your authorized representative notify the SK Geotechnical project
manager immediately of the presence and location of any underground objects on private property which
are not the responsibility of public utilities. Our services do not include subcontracting a private utility

precautions to avoid underground objects. In authorizing this contract, you agree to waive any claim
against SK Geotechnical and will indemnify and hold SK Geotechnical harmless from any claim of
liability, injury, or loss allegedly arising from our damaging of underground objects that were not called
to our attention prior to beginning the work.
