SUBJECT: Designation of the Public Works Director as the City’s Representative to the Middle
Creek Water Users Association.
MEETING DATE: October 19, 2015

RECOMMENDATION: Designate the Public Works as the representative for the City of
Bozeman for the purposes of voting on all matters brought before the membership of the Middle
Creek Water Users Association. BACKGROUND: The City of Bozeman is a shareholder in the Middle Creek Water Users
Association (the Association). Currently, the City owns 5,712 of the 10,184 shares in the
Association (56%). As a member, the City pays $30.55 per share released from Hyalite
Reservoir for municipal purpose and $5.00 per share for water not released. The City also pays proportionate share of annual operations and maintenance costs based on its share ownership.
The Association conducts an annual meeting in October of each year to discuss business matters
and elect members to the Board of Directors. The Board of Directors supervises and conducts
the business of the Association, sets assessments on shares, and may establish rules concerning the transfer of shares. The City, as a shareholder, must vote on the election of the Board of
Directors as well as other actionable items that may be brought to the vote of the Association as a
whole.
This action formalizes the past practice of having the City of Bozeman Public Works Director act as the representative for the City for the purposes of voting on all matters brought before the
membership of the Association.
