SUBJECT: Authorize the Director of Public Works and City Manager to approve the Lakes at
Valley West Phases 1-2 Subdivision Final Plat, Application 15396 and related
documents. MEETING DATE: October 5, 2015
AGENDA ITEM TYPE: Consent (Quasi-judicial)
RECOMMENDATION: That the City Commission approve the Final Plat for the Lakes at Valley
West Phases 1-2 Subdivision Final Plat, Application 15396 and authorize the Director of Public Works
to execute the same on behalf of the City of Bozeman upon review and approval by the City Attorney’s
Office and the City Manager to sign related easements.
BACKGROUND: On June 1, 2015, the City Commission approved the findings of fact completing the preliminary plat approval to subdivide 64.89 acres into 61 single-household lots, 2 restricted lots, related
streets, open space and park. The developer has applied for final plat review and approval for Lakes at
Valley West Phases 1-2 Subdivision platting all of the originally approved lots. The preliminary plat
was approved (5:0) by the City Commission on May 18, 2015.
Staff has concluded that all terms and conditions of the preliminary plat approval have been met. An improvements agreement has been completed for the future installation of water, sewer, streets,
signalization, sidewalks, open space and park improvements. The appropriate financial guarantee has
been received. The plat was approved for concurrent construction of infrastructure and homes.
Therefore, extensive deferral of required improvements is expected.
UNRESOLVED ISSUES: None determined at this time.
ALTERNATIVES: 1) Approve the final plat as presented and recommended.
2) Deny the final plat.
FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased property
tax revenues from new development, along with increased costs to deliver municipal services to the property.

Morrison-Maeirlie Engineering, on behalf of The Lakes at Valley West, Bozeman LLC (Applicant), has
made application to the City of Bozeman Department of Community Development for Final Plat review
and approval for the Lakes at Valley West Phases 1-2 Major Subdivision, a 26 lot subdivision.
Lakes at Valley West Phases 1-2 Major Subdivision will plat the initial area within the Lakes at Valley West Phases Major Subdivision which was granted preliminary plat on May 18, 2015 to
subdivide 64.89 acres to create sixty-one (61) single-household residential lots, two (2) restricted lots,
related streets, public part and private open space. Attached is a copy of the signed Findings of Fact and
Order dated June 1, 2015.
An Improvement Agreement is required for this subdivision; one for the installation of sidewalks, boulevard landscaping, installation of water and sewer, construction of streets, and the installation of
required park improvements.
Based on the summary review provided below the Development Review Committee, the Engineering
Division and the Department of Community Development have reviewed the application against the
conditions of preliminary plat approval; and as a result, find that the final plat application may be approved by the City Commission.
Three (3) original mylars of the Final Plat, original Platting Certificate, copy of the property owner
association documents and a copy of the Findings of Fact and Order are attached for your review. The
property owner’s association documents and other applicable documents will be recorded and filed with
the final plat at the Clerk and Recorder’s Office.
The Community Development staff respectfully requests that you prepare a City Attorney's
Certificate using the attached original Platting Certificate; approve the Certificates of Director of
Public Works and Certificate of Completion "as to form". The final City signatures will be obtained
once the City Commission has approved the final plat.
An application for final plat was submitted to the Community Development Department on August 25, 2015 and amended on September 24, 2015. Based on the applicant having submitted a complete

application the application was deemed complete on September 24, 2015, the 45-day (working days)
review period for this final plat would expire on December 2, 2015.
The conditions of preliminary plat approval, which are pertinent to this major subdivision and how they have been met, are described in the submittal materials. An exception to this are that it was determined
that a subdivision improvements agreements are required for uninstalled streets, water, sewer,
signalization, sidewalks, open space, and park improvements and boulevard landscaping. This is
expected as the project was processed and approved for concurrent construction of improvements and homes. The signed improvements agreement is in hand and the financial guarantee will be provided by irrevocable standby letter of credit from Bank of America N.A. The term of the LOC is one year and the
term of the IA requires completion of all work except lot frontage sidewalks within 9 months.
The Planned Unit Development has received final approval by the Director of Community
Development.
Note: The Community Development Department and Engineering Departments have also reviewed the final plat application against the preliminary plat cited code provisions and found compliance
with these code requirements. The Engineering Department has also reviewed and approved the
“closure” of the final plat.
