COMMISSION RESOLUTION NO. 3594
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, ESTABLISHING THE "2003 SIDEWALK PROGRAM" AND ORDERING
THAT SIDEWALKS BE INSTALLED IN CERTAIN AREAS OF BOZEMAN, AS
PROVIDED FOR IN SECTIONS 7-14-4109 AND 7-14-4110, MONTANA CODE
ANNOTATED.
WHEREAS, Section 7-14-4109, Montana Code Annotated, provides that a local governing body
may order sidewalks constructed in front of any lot or parcel of land; and
WHEREAS, the City Commission has established a program for installation of sidewalks along
streets throughout the entire community; and
WHEREAS, the City Commission did, on the 14th day of April 2003 adopt Commission
Resolution No. 3587, stating its intent to order in sidewalks along specified streets within the city of
Bozeman; and
WHEREAS, the City Commission did, after due and legal notice, on the 5th day of May 2003
conduct a public hearing on its intent to order in sidewalks; and
WHEREAS, after its public hearing, the City Commission did, on the 5th day of May 2003
determine that the installation of sidewalks along the below-listed streets is of high priority and is
necessary for the pedestrians of the City of Bozeman.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman.
Montana:
Section 1
That sidewalks are hereby ordered to be installed on both sides of the street, under the
provisions of Section 7-14-4109, Montana Code Annotated, and in accordance with the City's sidewalk
policy, as established in Commission Resolution No. 2965, as follows:
1. Flathead Avenue between Durston Road and Broadwater Street;
2. Teton Avenue between Durston Road and Broadwater Street;
3. Yellowstone Avenue between Durston Road and Ravalli Street;
4. Toole Street between the west line of Valley Unit Subdivision,
Phase I, and
the east line of Valley Unit Subdivision, Phase I;
5. Cascade Street between the west line of Valley Unit Subdivision,
Phase I,
and the east line of Valley Unit Subdivision, Phase I;
6. Broadwater Street between the west line of Valley Unit Subdivision,
Phase
I, and Sheridan Place;

7. Meagher Avenue between Broadwater Street and West Babcock
Street;
8. vvest Babcock Street between Granite Avenue and Yellowstone
Avenue;
9. Pondera Avenue between West Babcock Street and Ravalli Street;
10. Granite Avenue between West Babcock Street and Ravalli Street;
11. Ravalli Street between Granite Avenue and Yellowstone Avenue;
12. Fallon Street between the west line of Valley Unit Subdivision,
Phase I, and
Yellowstone Avenue;
13. little Horse Drive between South 3rd Avenue and Goldenstein
Lane;
14. Peace Pipe Drive between little Horse Drive and Morning
Sun Drive;
15. Graf Street between Peace Pipe Drive and Morning Sun Drive;
16. Morning Sun Drive between Peace Pipe Drive and Goldenstein
Lane, west
side only;
17. Rain Roper Drive between Peace Pipe Drive and Graf Street;
18. Silver Cloud Circle between Rain Roper Drive and the dead
end;
19. Graf Street between Peace Pipe Drive and the north line
of Sundance
Springs Subdivision, Phase 2B;
20. Rocking Bear Circle between Graf Street and the dead end;
21. Putter Court between Boylan Road and the dead end;
22. Valhalla Court between Boylan Road and the dead end; and
23. Meagher Avenue between Durston Road and the dead end to
the north.
Section 2
That, pursuant to Section 7-14-4109(3), written notice shall be mailed to every owner or agent
of the owner, and to any purchaser under contract for deed of such property, notifying them that they are
required to construct a City-standard sidewalk in front of their lot or parcel of land and, if they fail or
neglect to install said sidewalk by October 31, 2003, or within thirty (30) days of the date of the written
notice, whichever is the latter, the City may construct or cause to be constructed the sidewalk and will
assess them the cost thereof, including engineering costs and costs enumerated in Sections 7-12-4121
and 7-12-4169, Montana Code Annotated, against the property in front of which the sidewalk was
constructed.

PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a
regular session thereof held on the 12th day of May 2003.
