A. 06:02:13 PM Call to Order—6 p.m. Commission Room, City Hall, 121 North - Rouse Mayor Krauss called the meeting to order 6:02 p.m. B. Pledge of Allegiance and a Moment of Silence C. 06:03:15 PM Changes to the Agenda Mayor Krauss asked City Manager Chris Kukulski if there were any changes to the agenda. Mr. Kukulski stated that there will be a Special Presentation to introduce a Master Municipal Clerk from the Netherlands as well as moving Action Item. 3 to Action Item 5. He spoke regarding the size of the existing roadway and the safety concerns. He has concern of high density. 06:20:45 PM Public Comment Closed Mayor Krauss closed public comment. F. 06:20:48 PM Action Items 1. 06:20:51 PM Resolution 4618, Bozeman Pond Park Expansion Master Plan and Additional Funding Allocation for Initial Park Project Construction(Poissant) C= 06:21:03 PM Staff Presentation Trails, Open Space and Parks Manager Carolyn Poissant gave the Staff Presentation regarding Resolution 4618, Bozeman Pond Park Expansion Master Plan and Additional Funding Allocation for Initial Park Project Construction. 06:27:54 PM Commission questions for Staff The Commission and Staff discussed next steps, public comment, the present plan for parking, parking space configuration, the dog park area, connectivity, the condition of Fowler Street, the zoning of the area, increased housing in the future, the cost analysis, where the funding may come from, if Pond Row is in fact a necessity, the entry into the park and the distance of the access, the quantity of the parking spots in the parking lot and the amount of appropriate parking areas. 06:45:14 PM Public Comment Mayor Krauss opened public comment. 06:45:23 PM Dab Dabney, Public comment Mr. Dabney spoke on behalf of Haven and they would like the road to dead in at the shelter. They would suggest a paved road to the east side of the facility for emergency access only. He spoke regarding existing housing in the area and the connectivity issue. 06:48:19 PM Terry Cunningham,Public Comment Mr. Cunningham fiom Run Dog Run spoke regarding dog parks and the size of the dog park in that it is getting smaller than originally planned and hopes that whatever happens, it doesn't encroach on the size of their park any more. There is a need for a large park in that area. Page 3 of 15 Bozeman City Commission Minutes,July 27,2015 06:51:14 PM Motion that in consideration of all public input and information received to date, I hereby move to approve Resolution 4618, in order to approve the Bozeman Pond Park Expansion Project Master Plan as presented by staff, and authorize additional funding in the amount of$105,000 from the Trails, Open Space, and Parks Bond Fund premium revenues for construction of the paved, stubbed portion of Pond Row, gravel access drive, and gravel parking lot and associated infrastructure improvements as part of the Bozeman Pond Park Expansion Project. Commissioner- Chris Mehl: Motion Deputy Mqyor- Carson Taylor: 2nd 06:52:06 PM Discussion on the Motion Cr. Mehl thanked those involved. He will support this motion and would like to wrap this up. They have heard about the dog area. It is a worthwhile endeavor. He would like Staff to come back with some ideas. It would be good to have this discussion when they look at the variances. Traffic flow needs to be addressed. It is an appropriate time to discuss during site plan. Deputy Mayor Taylor stated he agrees with Cr. Mehl but would like more discussion and time to think through to close Pond Row permanently. He sees this as a choice. He spoke regarding different connectivity choices and the need to look at the parking lot and wants to know if building a bigger parking lot is needed. This is a question of policy of building Pond Row or not. Cr. Andrus supports and feels this is the least expensive option. Her one question is if the road doesn't go through, the amount raised by Haven for this, there may need to be discussion on how that money would be spent. Cr. Pomeroy supports the motion and she understands the importance of security. Mayor Krauss feels there is not enough parking but if Pond Row goes through we may have enough parking. It is not tied to anything. He would prefer to see how many people may show up for this. Spoke regarding variances and that he doesn't see anything on the map that would raise to a variance. May have some issues with this. He spoke regarding the need to determine how the dog park will be used and what will happen if Fowler is not improved. 07:07:05 PM Friendly Amendment to send this to the Development Review Committee (DRC) to seek recommendations in regards to transportation options to review a series of designs and then bring it back to the Commission. (Striking the first stated motion). No person commented. Mayor Krauss closed public comment. The Commission withdrew Item 2 based on the Action that took place in Action Item 1. Page 5 of 15 Bozeman City Commission Minutes,Judy 27,2015 07:24:26 PM Commission questions for Staff The Commission and Staff discussed the property area that is contiguous to the City property, the improvements to Babcock and the current Special Improvement District, Condition Number 7 in reference to the Babcock SID, the timing of the connection, the timing of the application, other applications that may pre-date the fee changes, the mapping, unintended consequences, the timing of the connection and costs related to impact fees and connections and monthly bills as well as paybacks and the timing of the application vs when the fees went into effect. 07:32:50 PM Applicant Presentation The Applicant Representative gave their presentation regarding a request for Annexation of.263 Acres with an associated 0.67 Acres of Right of way; and Amendment of the City zoning Map for the Establishment of an Initial Zoning Designation of R-2, Residential Medium Density Two-Household District, Application 15270, located at 2521 West Babcock Street. He would like a refund on the fees they paid. He spoke regarding the conditions and does not agree with condition 11 for the additional easement. 07:37:57 PM Commission questions for Applicant The Commission and Applicant discussed the other conditions apart from Condition 11 and the applicant agreed to them. 07:3 8:40 PM Public Comment Mayor Krauss opened public comment. Mayor Krauss closed public comment. 07:39:42 PM Public Hearing Closed Mayor Krauss closed the public hearing. 07:39:48 PM Motion that having reviewed and considered the staff report, application materials,public comment, and all information presented, I hereby adopt the findings presented in the staff report for application 15270 and move to approve the 2521 W. Babcock Street Annexation with recommended terms of annexation, and direct staff to prepare an annexation agreement for signature by the parties. Deputy Mayor- Carson Taylor: Motion Commissioner- Cynthia Andrus: 2nd 07:40:26 PM Commission discussion on the Motion Deputy Mayor Taylor stated that he recommends approving the motion including Condition 11. He is not sure what to think about the return on the fees. There was not an attempt to wait until the last minute. Cr. Andrus stated that she is going to approve the motion as submitted, leaving Condition 11 and leave the fee in there as well. Mayor Krauss should give them the additional fee money back. Cr. Mehl spoke regarding playing by the City's rules. 07:44:47 PM Friendly Amendment to return the extra $330 that was paid because of the fee increase instituted in April of this year. The City Attorney then spoke regarding the protest thresholds. 08:15:54 PM Commission questions for Staff The Commission and Staff discussed protest thresholds, zoning and annexations of this area and protocol if the Commission decides to zone the property something different,the size of the roadway, the R-4 zoning and other areas of this zoning in the City, the public comment related to agricultural buffers, the existing land use patterns, preservation of farm lands and open spaces, current development in the area, the Community Plan in regards to the agricultural area, a 20 acre buffer zone, the hard edge and avoiding feathering, the fact that Stucky will be a collector street, signalization in the area, intersections, the roads to MSU and their capability of handling growth here and the approximate cost of over two million dollars to build out this road to a collector standard, impact fee credits and where we have used them before. 08:38:01 PM Applicant Presentation The Applicant representative gave their presentation regarding a Request for Annexation of 20.62 Acres and a Zone Map Amendment of the City Zone Map for the Establishment of a Zoning Designation of R-4, High Density Residential District, Located at 3000 Stucky Road, Stucky Road Annexations 15-232 and 15-233. This is in compliance with the City growth policy. Page 8of15 Bozeman GOP Commission Minutes,July 27,2015 08:46:40 PM Commission questions for Applicant The Commission and the Applicant discussed the Conditions and the Applicant agreed to them. Discussion took place regarding a Condition no. 8 and the applicant has had conversations with the Public Works Department about Stucky road. 08:47:44 PM Public Comment Mayor Krauss opened public comment. 08:48:13 PM Don Seifert,Public comment Mr. Seifert spoke as a County resident although he is a County Commissioner and the concerns related to zoning and feels R-3 is more appropriate and asked the Commission to consider the R-3 zoning instead. 08:51:20 PM Tracy Stallings,Public Comment Ms. Stallings stated that she lives in the County and the housing is expensive in the City limits. She spoke regarding concerns of shallow water tables and stated that by having student housing near campus, this will lesson traffic. She spoke in support of the location of this project. 08:53:03 PM Dave Reynolds,Public Comment Mr. Reynolds spoke in support of the project. It is appropriate so close to MSU. He would rather see controlled expansion. 08:54:39 PM Dillon Strike,Public Comment Mr. Strike stated that he is opposed to changing the zoning and the high density. He spoke regarding what is being grown in this area and the compatible use for Agricultural. The entire plan needs to be reworked. Consider the soil. 08:57:53 PM Renea Gavin,Public Comment Ms. Gavin spoke regarding the fact that she lives on a farm to the west and that there are more green shaded areas that are not being shown on the map. She spoke regarding the area bubbling up from the grass roots. 09:00:54 PM Steve Cadlin,Public Comment Mr. Cadlin stated that he is from North Carolina and this is good planning. He spoke regarding R-4 zoning and that it is good planning. This is something that needs to be done. 09:02:51 PM AZ Lein,Public Comment Mr. Lein spoke in support of Agriculture and spoke regarding soils as it was discussed in the newspaper. Ag should get a little more recognition. 09:05:05 PM Lloyd Mandeville,Public Comment Mr. Mandeville represents the developers and was charged with finding land for this project. R3 does not have the density that R4 does. A school is coming in on Cottonwood potentially. He spoke regarding the Community Plan. Page 9 of 15 Bozeman City Commission Minutes,July 27,2015 09:08:10 PM Jamie Fedder,Public Comment Mr. Fedder spoke regarding the safety of the road and how it is used as a short cut. It is not a safe road. It is not just county people impacting this road. 09:10:14 PM Tom Elizan,Public Comment Mr. Elizan spoke regarding the other areas in the area related to the property vicinity and spoke regarding the Agricultural and viable farms near the City. He is opposed to the changes. 09:14:50 PM Public Comment closed. Mayor Krauss closed public comment. 09:14:57 PM Applicant rebuttal The Applicant representative spoke regarding commercial proximity, the wetlands delineation and that the DRC recommended approval of this. High density helps preserve agricultural land and he urged the continuance of allowing development in order to keep prices affordable. 09:17:21 PM Commission questions for Staff. Commissioner - Cynthia Andrus: Motion Commissioner -I-Ho Pomeroy 09:20:25 PM Commission discussion Cr. Andrus spoke regarding developing to the west and that it is smart but has an issue with not having a plan for Stucky road. Doing a large development without a plan is a concern,just because it is affordable is not a reason to annexation and tourism is a part of this as well. Cr. Pomeroy stated that they have received many emails and this place is close to the City and MSU and Oracle employees, focus on high density housing, need to think of what is best for the citizen, we can bring food from other places but not housing and spoke of the community of commuters. Improving Stucky road will benefit all. Mayor Krauss stated that this is the natural area for the City to grow. There are no employers heading west. We are trying to make decisions for the people of Bozeman. Page 10 of 15 Bozeman Cify Commission Minutes,July 27,2015 The City spoke regarding hard edges, it is important to build or cities next to our employers, it is a little beyond us. Cr. Mehl spoke regarding goals and policy as they relate to annexation, and feels that it is not that far out because there is water and sewer in that area, the fact that there was an expectation that this area would grow, the fact that 19th is busier and that he see this as an infill and Bozeman is booming, the need for R-4 zoning, it is a worthwhile risk to annex this property. Deputy Mayor Taylor spoke regarding the high school on Cottonwood, northwest concerns related to sewer, spoke regarding pushing infill growth, growing the City sustainably and how to apply this principal, not losing sight of agriculture and the potential edge, will vote for but proposes that the motion to add the item for Stucky be added. Feels there is a value of people being in the City and being connected to infrastructure. 09:53:42 PM Amendment to the Main Motion to add Condition 8, which would say that any annexation agreement would address the upgrade of Stucky road's capacity and used to City Standards (all applicable code provisions and that when the annexation agreement is done there will be a plan for Stucky road). Commissioner- Cynthia Andrus: Motion Commissioner- I-Ho Pomeroy: 2nd 09:56:50 PM Commission discussion on the Motion Cr. Mehl asked that a summary of what is allowed in R-3 and R-4 zoning areas. We are growing and there are many young people moving here. Cr. Andrus spoke regarding the development of this area and it does make sense. Mayor Krauss spoke regarding adding R-3 over the years. Annexations have been R-3 but if we want apartments, we need to go R-4. Deputy Mayor Taylor stated that he lives across from a large apartment complex and he doesn't have problems with it. Cr.
