The CUP is required for the establishment of extended stay lodging in an R-1 zoning district. The property is zoned R-1 (Residential Single-Household,Low Density) and is legally described as Lots 34-36,north half of lot 33,Block 7,Fairview Addition to Bozeman,City of Bozeman,Gallatin County,Montana. The purpose of the public hearing is to consider the Conditional Use Permit application for the 15380 624 South Willson Extended Stay CUP project, requested by property owner Robert and Amanda Harris, 122 Rosemary Avenue, San Antonio,.TX pursuant to Chapter 38 (Unified Development Code— UDC)of the Bozeman Municipal Code(BMC). Box 1230 Bozeman, MT 59771-1230 TO: Bozeman City Commission SUBJECT: Conditional Use Permit# 15380 624 South Willson Avenue Public Hearing September 28, 2015 We oppose the issuance of Conditional Use Permit# 15380 for 624 South Willson Avenue that would allow vacation rentals for up to thirty days as"Extended Stay Lodging." We oppose the issuance of this permit for the following reasons: 1. South Willson Avenue is within the Bon Ton Historic District. The operation of vacation rental property(extended stay lodging)is inconsistent with the historic nature of the neighborhood, which is zoned R-1. The homes surrounding 624 S. Willson are historic, single family residences. South Willson is often showcased as reflecting the beauty and hometown culture of Bozeman. For example,the recent Bozeman Marathon featured South Willson as the entryway to Main Street. Undoubtedly, South Willson is one of the premier streets in Bozeman and the state of Montana. The increased traffic, noise,parking, and transient nature of the renters of 624 S. Willson will have an adverse impact on the neighborhood and South Willson Avenue. In addition, granting this Conditional Use Permit will set a precedent for others to request similar zoning exceptions in R-1 neighborhoods throughout Bozeman. 2. Longfellow Elementary School is located within a block of the 624 South Willson. Children walking to Longfellow cross the alley between South Willson and South Tracy. The alley would be used by renters of 624 S. Willson to reach Dickerson,which is the closest cross street. Drivers approaching Dickerson from the alley are blinded from seeing the sidewalk because of yard fences. Current residents approaching Dickerson from the alley proceed cautiously, often honking their horns to alert anyone on the sidewalk of their approach. Renters unfamiliar with the existence of the school and blind entryway to Dickerson put Longfellow students at risk. In addition,the transient nature of the renters of 624 S. Willson raise additional safety issues for Longfellow students. For example, who will monitor renters of 624 S. Wilson for possible sex predators? Allowing 624 S. Willson to be used as lodging will have little or no economic impact on Bozeman. 4. The current owners of 624 S. Willson, Robert and Amanda Harris, are absentee owners. Since buying the home in 2014, they have not occupied the home for more than a few weeks at a time. As a result, they have not experienced nor appreciate the historic, quiet nature of the neighborhood that they are proposing to change. 5. The owners, Robert and Amanda Harris,were aware of the R-1 zoning of 624 S. Willson when they purchased the home in 2014. To propose a rezoning of 624 S.
