A tract of land being part of a remainder of Tract 6, Smith Subdivision as described
in Doc. 2019006, as filed with the Gallatin County Clerk & Recorder, located in the
northwest quarter of Section 11, Township 2 South, Range 5 East, P.M.M., Gallatin
County, Montana, being more particularly described as follows:
A strip of land lying south of and being 45.00 feet wide, when measured at right
angles from the following line:
Commencing at the northwest corner of said Section 11; thence along the north line
of said northwest quarter, South 89003' East a distance of 910.3 feet, more or less, to the
northeast corner of said Remainder Tract 6, and the True Point of Beginning;
Thence continuing along the north line of said northwest quarter, and along the
north line of said Remainder Tract 6, South 89003' East a distance of 189.8 feet, to the
northeast corner of said Remainder Tract 6, and the end of the line herein described.
The ends of said strip of land are lengthened or shortened, as required, to terminate
on the east and west lines of said Remainder Tract 6.
Said strip of land contains 8,541 square feet, more or less.

1. IN CONSIDERATION OF THE PAYMENTS HEREIN SET FORTH AND THE
SPECIFIC AGREEMENTS TO BE PERFORMED BY BOTH PARTIES HERETO
AND WRITTEN IN THIS AGREEMENT, THE PARTIES HERETO BIND
THEMSELVES TO THE TERMS AND CONDITIONS SET FORTH HEREIN. NO
VERBAL AGREEMENTS SHALL BE BINDING UPON EITHER PARTY AND THIS
AGREEMENT SHALL BECOME EFFECTIVE UPON EXECUTION BY A
DESIGNATED REPRESENTATIVE OF THE CITY OF BOZEMAN

5. IT IS UNDERSTOOD AND AGREED THE CITY OF BOZEMAN SHALL MAKE
THE FOLLOWING DISBURSEMENT OF PAYMENT.
A. Within 30 days following the establishment, including the receipt of the
funds from the sale of bonds, of an Special Improvement District for the
Durston Road Improvements from 19th Avenue to Ferguson Avenue,
Orville F. Christenot Trust and Annette F. Christenot Trust agree to
send a properly executed Quit Claim Deed for the above-described
property to the City of Bozeman.
Within 30 days after acceptance of the Quit Claim Deed, the City of
Bozeman will issue a warrant in the amount of $21,760.00, to be made
payable to Orville F. Christenot Trust and Annette F. Christenot Trust
and mailed to 5200 W. Durston Road, Bozeman, MT 59718~9053.
B. Although it is the intent of the parties to pay for the purchase of this
property through funds raised after the establishment of a Special
Improvement District, as set forth in Paragraph 5. A. above, the City of
Bozeman may choose to purchase the property under the terms of this
Agreement at any time. The City shall notify the property owner in
writing of its decision to purchase the property. Said option to purchase
shall forever terminate within thirty (30) days of the failure of the Special
Improvement District, or December 30, 2005, whichever is later.
If the City notifies the property owner that the City intends to purchase the
property, the property owner shall have 30 days from the receipt of such
notification to send a properly executed Quit Claim Deed for the above-
described property to the City of Bozeman, and within 30 days after
acceptance of the Quit Claim Deed, the City of Bozeman will issue a
warrant as specified in Section 5.A., above.
If the City notifies the property owner that the City does not intend to
purchase the property, the City will return, unfiled, any Quit Claim Deeds
received from the property owner, and this Agreement shall be null and
void.
6. POSSESSION OF THE PROPERTY will be turned over to the City of Bozeman at the
time the Quit Claim Deed is accepted by the City of Bozeman.
7. The City of Bozeman shall be responsible for all costs and fees associated with this
transaction, including, but not limited to: the preparation of all documents of transfer,
closing fees and recording fees.
8. Construction of the roadway, may require minor entry by the City's contractor on the
adjoining property to reset fences, form and finish sidewalks and tapering of the roadway
grade to match the adjoining ground. Any disturbance of the temporary construction
permit ground will be left in a good, workmanlike condition, satisfactory to the owner.
9. All tenns of this agreement shall be binding upon and inure to the benefit of, and be
enforceable by the heirs, assigns and personal representatives of the parties.
10. This Agreement shall expire one (1) year from the date it was recommended for approval
by the agent for the City of Bozeman as set forth below.
