Barnard Easements Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Brian Heaston, Project Engineer SUBJECT: Authorize the City Manager to sign a Release and Reconveyance of Easement to remove an existing water easement from property owned by Timothy Barnard at 701 Gold Avenue and to sign as Grantee a new Water Pipeline and Access Easement and Agreement with Timothy Barnard as Grantor for a water main and fire hydrants located at the 701 Gold Avenue property. MEETING DATE: September 14, 2015 AGENDA ITEM TYPE: Consent RECOMMENDATION: Authorize the City Manager to sign a Release and Reconveyance of Easement to remove an existing water easement from property owned by Timothy Barnard at 701 Gold Avenue and to sign as Grantee a new Water Pipeline and Access Easement and Agreement with Timothy Barnard as Grantor for a water main and fire hydrants located at the 701 Gold Avenue property. BACKGROUND: The campus of Barnard Construction, located at 701 Gold Avenue, is being expanded under an approved Master Site Plan #Z-13028. A new 8” diameter water main was installed on the project site in accordance with approved plans and specifications. A water pipeline and access easement and agreement was granted to the city by Mr. Barnard for the new water main. An amendment to the Master Site Plan was approved subsequent to the initial approval of the project to reconfigure the footprint of the proposed office building expansion. Changes to the locations of fire hydrants were made with the master site plan modification. Since the constructed location of the fire hydrants falls outside of the water pipeline easement originally granted, a new water pipeline and access easement and agreement is needed. Two documents are attached to this memorandum to resolve the easement issue: 1) Release and Reconveyance of Easement to remove the existing water line easement from the property; and 2) a new Water Pipeline and Access Easement and Agreement to provide an easement for the constructed water main and fire hydrants. City Engineering Staff has reviewed the documents and finds them acceptable for execution by the City Manager. UNRESOLVED ISSUES: None. ALTERNATIVES: As suggested by the City Commission.
