MOA Gallatin CountyPage 1 of 2 Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Chuck Winn, Assistant City Manager SUBJECT: Memorandum of Agreement with Gallatin County for the Preliminary Development of the Law and Justice Center Site. MEETING DATE: September 14, 2015 AGENDA ITEM TYPE: Action RECOMMENDATION: Approve Memorandum of Agreement (MOA) with Gallatin County for the Preliminary Development of a joint project at the Law and Justice Center site (L&J). PROPOSED MOTION: Having considered public comment and the information presented by staff, I hereby move to approve the Memorandum of Agreement with Gallatin County for the Preliminary Development of the Law and Justice Center Site. BACKGROUND: On February 23, 2015, the Bozeman City Commission adopted Resolution 4580 establishing an advisory committee to explore City and County cooperation for joint improvements at the Law and Justice Center campus. The Joint Advisory Committee met seven times drafting recommendations that were presented to both governing bodies in July of 2015. The recommendations included a framework to explore the development of joint City-County law and justice facilities on the current L&J campus. On July 13, 2015, the Bozeman City Commission adopted Resolution 4324 formally adopting the recommendation of the Joint Advisory Committee. The County Commission adopted the recommendations on July 14, 2015. Subsequent to those actions, staff and elected officials from both the City and County have been developing a joint solicitation process and MOA for continued collaboration. That MOA is before you tonight and includes initial agreements in four areas: • Project Description • Reservation of Project Site on the L&J campus • Description of Joint Project • Provisions for allocation of design costs UNRESOLVED ISSUES: Should the City Commission approve this MOA, we will continue with the joint procurement process and negotiate a contract with the successful respondent for architectural services. That agreement is expected to come before the City Commission on September 21, 2015. A second comprehensive interlocal agreement detailing the specific conditions of a more formal and ongoing relationship is being developed. 175 Page 2 of 2 ALTERNATIVES: None identified. FISCAL EFFECTS: The approved FY16 budget includes $50,000 for continued planning efforts for police and courts facilities. Additionally, the City Commission held $450,000 in the City’s general fund reserve for possible allocation for design services. Funding for the services anticipated in this MOA will require the City Commission approve a budget amendment, as the costs are certain to exceed the $50,000 that is currently budgeted. The exact costs of those services will be negotiated and are not known at this time. The budget amendment will be prepared for Commission review prior to the execution of any contract for services.
