PROJECT REVIEW
1. Stucky Road Zone Map Amendment 15233 (Rogers)
A zone map amendment proposing to zone 20.62 acres as R-4 (High Density Residential
District) contingent upon annexation. The property is located at 3000 Stucky Road and is
legally described as a Tract of Land situated in the West One-Half (W ½) of the Northeast
One-Quarter (NE ¼) of the Northwest One-Quarter (NW ¼) of Section 23, Township Two
South (T2S), Range Five East (R5E), PMM Gallatin County, MT.
06:16:25 PM Tom Rogers begins presentation of the Stucky Road Project
06:16:59 PM Tom Rogers passes out addition public comment received just prior to the meeting.
06:17:39 PM Tom Rogers does overview of his presentation for the evening.
06:18:30 PM Overview of what the project includes – and highlights that the zoning commission is only responsible for
the zoning of the project. Annexation is not handled in the zoning commission; it is completely handled within the City
Commission.
06:20:07 PM Presents the location of the property and how it relates to the community plan and current zoning around
the property.
06:24:15 PM Tom Rogers discusses the issue or transportation and utilities.
06:29:25 PM Tom Rogers discusses public comment received.
06:30:28 PM Questions for the staff begins.
06:31:02 PM George Thompson raised the question about installing infrastructure – what is required and who will be
responsible for it.
06:31:41 PM Tom Rogers responds in detail about what is required of infrastructure.
06:32:54 PM George Thompson raises question about accessibility for students due to road condition and lack of

sidewalks. He doesn’t see the property being safely accessible by anything other than motor vehicles.
06:34:28 PM George Thompson raises question of access to water
06:34:47 PM Tom Rogers says that water access may be an issue, but we do not currently have that information
available. We would have to look further into easements available.
06:35:23 PM George Thompson questions whether the property is compatible with the surrounding area. Should we have
the hard edge or filter it out to lower density – specifically as it borders an agricultural property.
06:37:18 PM Tom Rogers replies that the applicant feels its conducive to the other zoning areas in the area and fits with
the community plan.
06:39:15 PM George Thompson questions if we are increasing density where it needs to be increased. Should we instead
be increasing density closer to the campus?
06:40:16 PM Board Chair mentions that necessity is not part of the criteria and that perhaps that should not be included
when making a decision about the property.
06:40:46 PM Tom Rogers explains that it’s the applicant’s responsibility to create a case for themselves. He feels that it
meets or is neutral on enough of the criteria to make it conducive to the Community Plan. He feels that the Community
Plan foresees enough growth in the future, so that its location on the outskirts of the town is not an issue.
06:43:35 PM Tom Rogers makes the argument that density helps with community services and delivering those services.
It also aides in preserving agriculture land.
06:45:02 PM Julien Morice presents questions for staff.
06:45:19 PM Julien Morice questions how much the board should put their on their blinders. He feels there are currently
pieces of land designated for high density that are sitting vacant. He’s aware they are not there to dictate the market, but
to instead make a decision about zoning, however, he feels that to make a decision that’s best for the community perhaps
it’s best to step out of the criteria the zoning commission should be using to make a decision.
06:48:22 PM Board Chair said that if they stay in the realm of the gray area that is encompassed by the criteria, that it’s
ok. But to reach too far into areas that have little to do with the actual zoning of the property, then
06:49:15 PM Tom Rogers replies that the board members have broad discretion to determine if this is in the best interest
of the city.
