Box 1230 Bozeman, MT 59771-1230 2518683 PLATTE Page: 1 of 4 07/27/2015 09:50:44 AM Fee: $28.00 Charlotte Mills — Gallatin County, MT MISC 111111111111111111111111111111111111111 11111111111111111 III 1111111111 DRAINAGE PIPE EASEMENT Kraska and Sons Properties,LLC, a Montana limited liability company with address of 2254 Snow Flake Court, Bozeman, Montana 59715, GRANTOR, in consideration of One Dollar ($1.00) and other good and valuable consideration, receipt of which is acknowledged, grants to the City of Bozeman, a municipal corporation of the State of Montana,with offices at 121 North Rouse Avenue, Bozeman Montana 59715, GRANTEE, its successors and assigns, a perpetual easement for public drainage purposes, in which a drainage pipe shall be installed and located in, through and across the southwest corner of Lot 2 in Block 1 of PT Land Subdivision, Phase 1, located in Section 1, Township 2 South, Range 5 East, P.M_M., Gallatin County, City of Bozeman, Montana, in the location more particularly described as follows and on the attached Exhibit A, which is incorporated herein. The GRANTOR warrants that it is lawfully seized and possessed of the real property described above, that it has lawful right to encumber Lot 2, or any part of it. GRANTEE acknowledges that GRANTOR, at GRANTOR'S sole cost and expense may install landscaping in the easement area. Said landscaping shall be the type that shall not interfere with the use of the easement. Should GRANTEE be required to maintain the drainage pipe within the easement area GRANTEE shall take every reasonable precaution to save and salvage any landscaping within the easement and GRANTEE shall re-install the saved and salvaged landscaping to the best of GRANTEE's ability. GRANTEE is under no obligation to ensure or replace landscaping which GRANTEE removes or harms in the maintenance of the drainage pipe. The terms, covenants and provisions of the easement and agreement shall extend to and be binding upon the heirs, executors,administrators, personal representatives, successors and assigns of the parties hereto. �-T I I Dated this `0 day of Mey,2015.
