H. 06:07:42 PM Action Items 1. 06:07:23 PM A Conditional Use Permit to allow the Establishment of an Accessory Dwelling Unit within a Single-household Residence and Certificate of Appropriateness to allow the Demolition and Construction of a Single-household Residence located at 1201 South Grand Avenue, Stillman/Edelen CUP/COA Application Z15027 (Quasi Judicial) (Davis) 06:07:46 PM Staff Presentation Associate Planner Heather Davis gave the staff report presentation on a conditional use permit application to allow the establishment of an accessory dwelling unit within a single house hold residence and Certificate of Appropriateness to allow the Demolition and Construction of a single household residence and roof top solar panels on a property located at 1201 South Grand Avenue, Stillman/Edelen CUP/COA Application Z15027. Mrs. Davis goes into detail about the residential area. The Home on South Grand was discussed in detail. Access to the home was discussed as well as the details of the existing footprint and the changes in design per the application. Staff states that the design meets COA and design guideline criteria. 06:19:13 PM Commission questions for staff The Commission and staff discussed the plan as well as public comment concerning the design further via question and answer session in detail. Height of the home, conditions of approval and code provisions were further discussed. The existing structure was not structurally sound, the electrical needed to be updated up to code and demolition and reconstruction was more affordable for economic reasons. Esthetics per the design guidelines was discussed. Structures in the neighborhood contained a combination of short and tall structures and the applicant felt that the design of the home was within the median of what currently exists. 06:31:04 PM Commission questions for the Applicant The Commission and Applicant discussed the conditions and the applicant agreed to them. 06:34:07 PM Public Comment Mayor Krauss opened public comment. 06:34:17 PM Mary Vant Hull,Public Comment Ms. Vant Hull stated that the neighborhood parking is usually an issue. Parking per rooms should exist and worries about how this new structure will affect parking. 06:37:00 PM Todd Walkinson,Public Comment Mr. Walkinson talked about what the new changes are going to mean when modern design is added to historic communities and their structures. 06:39:02 PM Jean Walkinson,Public Comment Ms. Walkinson talked about her concern about the design guidelines of this home and the non-conforming style. She worries about the design make up of the historic core in the historic district. 06:41:05 PM Public Comment closed Mayor Krauss closed public comment. 06:41:21 PM Staff Brian Kruger responds to public comment about the historic design and their response to that. One set of design guidelines exist for the majority of Bozeman. This particular neighborhood has various different eras of design in the homes that currently exist. 06:45:37 PM Motion that having reviewed the Conditional Use Permit to allow the Establishment of an Accessory Dwelling Unit within a Single-household Residence and Certificate of Appropriateness to allow the Demolition and Construction of a Single-household Residence located at 1201 South Grand Avenue, Stillman/Edelen CUP/COA Application ZI5027. Deputy Mayor Taylor discussed reasons for voting for or against the design. City Attorney Greg Sullivan explained the ADU and the legal ramifications when considering what design guidelines where met and not met with the staff before considering a vote. Deputy Mayor Taylor and other commission members discussed the neighborhood, this proposed design and concerns about the way the home would fit in the existing neighborhood. Mayor Krauss stated that the criteria versus the construction of the home were within guidelines. 06:54:44 PM Staff suggests that the principle dwelling or accessory dwelling needs to be occupied by the applicant per the Bozeman municipal code which gives way to a friendly amendment change by commissioner Mehl which states . More discussion was held by the City Commissioners. 07:06:34 PM Vote on the Motion that having reviewed and considered the application materials, public comment, and all the information presented, I hereby adopt the findings presented in the staff report for application Z-15027 with a friendly amendment to condition #2 to reads as follows: No more than one of the dwellings, either the principal dwelling or the accessory dwelling, may be rented at the same time. One of the swellings shall be occupied as a principle residence by the property owner, per code provision Section 38.22.030.A.1, BMC and move to approve the Stillman/Edelen Accessory Dwelling Unit Conditional Use Permit and Certificate of Appropriateness to allow the establishment of an accessory dwelling unit in the basement of the existing residence and the demolition and construction of a single- household residence with conditions and subject to all applicable code provisions. Deputy Mayor - Carson Taylor: Motion Commissioner - Chris Mehl: 2nd Mayor - Jeff Krauss: Approve 2. 07:07:08 PM Resolution 4584, Creation of Special Improvement Lighting District 723 for Four Points Subdivision(Rosenberry) 07:07:11 PM Staff Presentation Administrative Services Director Anna Rosenberry presented a presentation on Resolution 4584, Creation of Special Improvement Lighting District 723 for Four Points Subdivision. Ms. Roseberry went into detail about the street light fixtures, the cost and maintenance. 07:08:49 PM Commission questions for Staff The Commission asked about lighting and issues that residence may have. Craig Woolard explained the LED Lighting in detail and addressed Commissioners' concerns via question and answer session concerning lighting. Mayor Krauss closed public comment. 07:10:39 PM Motion and Vote having considered public comment and all information presented,I move to approve Resolution 4584, Creating Special Improvement Lighting District 723 for the Four Points Subdivision. Commissioner - Chris Mehl: Motion Deputy Mayor- Carson Taylor: 2nd Mayor- Jeff Krauss: Approve 3. 07:11:08 PM Downtown Business Improvement District Fiscal Year 2016 Budget and Work Plan(Chris Naumann,Executive Director) 07:11:25 PM Staff Presentation Chris Naumann gives presentation on the BID. Programs such as graffiti removal and trash removal were discussed. Over 1500 hours was invested by staff in order to keep Downtown clean and presentable. 248 flower baskets where maintained in the downtown district and a tree replacement program and downtown marketing was also discussed in detail during the presentation as well as various other programs supporting the Downtown Business Improvement District Fiscal Year Budget and Work Plan. 07:18:03 PM Public Comment Mayor Krauss opened public comment. No motion necessary. 4. 07:19:13 PM Downtown Tax Increment Finance District Fiscal Year 2016 Budget and Work Plan(Chris Naumann, Executive Director) 07:19:27 PM Staff Presentation Chris Naumann talked about the Downtown TIFF Mission to increase investment, improve infrastructure and maintain TIF programs. Mr. Naumann discussed the Bridger Park Garage, the Fiber Network Implementation and Public Parking Lot improvements. The explosion Impact Fee Mitigation was discussed the Hotel Incentive Program and Residential Incentive Program was also discussed. 07:29:58 PM Commission questions for Staff Mayor Krauss asked Staff to discuss the health of Downtown. He talked about capturing taxable value to build a second parking garage was asked to which staff addressed. Staff discussed the health of downtown and perceived complication in the future. Current land use trends and parking infrastructure will be considered in the future. No motion necessary. 5. 07:42:34 PM Northeast Urban Renewal Board Fiscal Year 2016 Work Plan and Budget(Fontenot) 07:42:49 PM Staff Presentation Brit Fontenot Economic Development Director gave the presentation for Tom Noble who was not available to make it. Boundaries' of the Northeast Urban Renewal District was discussed. The proposed budget was discussed in detail. Property value was discussed as well. 07:47:15 PM Commission question for Staff The Commission and Staff discussed finishing projects and using funding to do so. 07:48:13 PM Public Comment Mayor Krauss opened public comment. No motion necessary. 6. 07:48:30 PM North Seventh Avenue Urban Renewal Board (NSURB) Fiscal Year 2016 Work Plan and Budget (Fine) 07:48:47 PM Staff Presentation David Fine discussed the lighting project that will be continued down through Main Street from north seventh. Various grants like the HRDC Community Caf6 Rehabilitation Grant, the Universal Athletic Rehabilitation Grant, Expansion and engineering development was discussed in detail. The goal this year is to complete projects currently in existence. 07:54:25 PM Commission questions for Staff Deputy Mayor Taylor asked about the vision of the North Seventh Avenue Urban Renewal Board. David Fine answered those questions Mayor Krauss discussed the midtown name given to the location around north 7th and also discussed making the area around the north seventh urban renewal district area attractive. Mayor Krauss cautioned that staff needs to consider issues that may exist Page 7of10 June 1,2015 Bozeman City Commission DRAFT Minutes within the area. Properties that are not being utilized but can be used in a positive way was something that the Mayor wanted to see. No motion necessary. 08:09:38 PM Break Mayor Krauss called for a 20 minute break. 08:22:58 PM Meeting was called back into session. Mayor Krauss called the meeting back to order. 7. 08:23:47 PM 2015 Wastewater Collection System Facility Plan Update (Woolard/Murray) 08:24:05 PM Staff Presentation Craig Woolard introduced James Nickelson and Coralynn Revis who presented the waste water study. Plan components were discussed such as the system inventory and existing flows in the system. That information was used to check for capacity and explanation for the design of a future system. Other waste water systems that served large populations was considered when making flow calculations. Data sources, GIS previous efforts, Record drawings as well as pipe size and location were also considered for future planning efforts. Coralynn further went in to detail about community plan boundaries, topography, projected population increase and near term improvements per the cities growth and what the data presented showed could be done to improve water flow in the future long term in order to maintain the drainage basin integrity. James Nickelson provided recommended policies to further improve upon elevation systems and programs already in place. 08:44:18 PM Commission questions for Staff The Commission and Staff discussed water conservation via working on the pipes and how the city could reduce water use. Craig Woolard stated that an aggressive water inflow program was in place to keep overall flows down. Cr. Mehl asked for clarification of data used per capita or waste water flow rate without the consideration of tourists. James Nickeeson clarified by stating that the values in the staff report is modeled with actual water usage data from tourists and future projection is modeled by residential or commercial use. Staff also joined in this conversation in detail about the type in the system and reasons why numbers in the water flow study may fluctuate. The ground water levels change and are not as consistent to be able to provide an accurate assessment of water used and money spent to quantify one specific percentage rate. Continued flow monitoring was suggested. Water rate percentages and estimates for FYI was discussed. 09:15:20 PM Public Comment Mayor Krauss opened public comment. No person commented. Deputy Mayor- Carson Taylor: Motion Commissioner- Chris Mehl: 2nd 09:15:55 PM Connnission discussion on the Motion Deputy Mayor Taylor commended the study Cr. Mehl talked about the future of the plan and thought that as long as we continue with the plan that would be great. Mayor Krauss stated that having foresight about growth and population is a good way to plan our investment in waste water conservation.
