HomeMy WebLinkAboutResolution 4624 -4324 (numbering error) Adopting the Recommendation of the Joint Advisory Committee for Cooperation on Joint Improvements at the Law and Justice Center Campus %0Z e� .. rp cc,# COMMISSION RESOLUTION NO. 4324 A RESOLUTION ADOPTING THE RECOMMENDATION OF THE JOINT ADVISORY COMMITTEE ESTABLISHED TO EXPLORE GALLATIN COUNTY AND CITY OF BOZEMAN COOPERATION ON JOINT IMPROVEMENTS AT THE LAW AND JUSTICE CENTER CAMPUS. WHEREAS,the City recognizes the need for a new facility to such a degree that a bond issue was proposed to the voters;which vote ultimately failed; and WHEREAS,the County recognizes the need for a new facility to such a degree that a reserve account has been established for the purpose of designing a facility in order to present a bond issue to the voters by 2016; and WHEREAS, the County and City recognize that there is public benefit to co-locating Law and Justice facilities and operations; and WHEREAS, the parties have previously worked in successful partnership developing the County 911 Dispatch Center and Bozeman Fire Department Station No. 3, co-located at 1705 Vaquero Parkway,Bozeman,MT 59718;under a certain condominium agreement; and WHEREAS, Gallatin County and the City of Bozeman are committed to explore further cooperation for co-location of law enforcement and courthouse buildings, infrastructure, parking, and facilities at the Law and Justice Campus, 615 South 16 'St.Bozeman,MT; WHEREAS, Gallatin County and the City of Bozeman created a joint advisory committee tasked with: 1. Determining if the Master Plan and needs assessments for the Law and Justice Campus are still valid. 2. Reviewing and determining if the Findings of the Law and Justice Task Force from 2012 are still valid. Identifying challenges and opportunities to cooperation on a joint facility; and 4. Making a recommendation to the respective Commissions on a joint facility or separate facilities and drafting a resolution based on that recommendation for each Commission to consider no later than July 1,2015. WIEREAS, the Joint Advisory Committee makes the following findings and recommendation for the consideration of the County and City Commissions: Findings: 1. The Master Plan and Needs Assessment are still valid.However,the County needs to update its assessment to reflect the changing projections of population growth in Gallatin County and the change in operations of the Sheriff's Office; 2. The findings of the Law and Justice Task Force from 2012,with the exception of construction numbers and costs calculated using those numbers,are still valid in 2015; 3. The challenges to cooperating on a joint facility are many,including defining the project; whether or not to phase the project between law enforcement and the courts; determining ownership; agreeing on equitable cost distribution;the timing and cost of design,voter approval, and construction,how to bond the project,the limitations of the site,and how to future proof the project. 4. There are also many opportunities inherent in a joint project,including maximising financial, operational, and construction efficiencies;maintaining the existing excellent professional relationship between law enforcement agencies; and better serving the citizens by keeping all aspects of the criminal justice system co-located. 5. It is the desire of both Commissions to present this to the electorate in the November 2016 general election. As such,it is critical the process to begin design start immediately. Recommendations: 1. The Joint Advisory Committee recommends,after careful consideration of alternatives, discussion with various stakeholders and experts,including bond counsel,that Gallatin County and the City of Bozeman take the appropriate steps to jointly design and construct a new facility or facilities for the Gallatin County Sheriff's Office,Bozeman Police Department,District and Justice Courts,Municipal Courts, City Attorney's Office, Victim's Witness, and adjunct groups,the County Attorney's Office, Court Services, Probation, Guardian Ad Litem,and the Clerk of District Court. The Joint Advisory Committee recommends that the facility be financed through a County bond issue and a City bond issue for the respective portions of the facility and that the ownership be a condominium structure with operating agreements similar to the County 911 Dispatch Center and Fire Station 3. 2. The City and County create a working group comprised of an equal number of City and County representatives. The specific responsibilities of this group will include,but may not be limited to,the creation of the overall project timeline, agreement on joint procurement processes,selection of the project delivery model,drafting of Request for Page 2 of 3 Resolution 4324,adopting Recommendations of theJointAdvisoty Committee forlmprovements at the Lmv and Justice Center Campus Qualification(RFQ) and Request for Proposal(RFP)documents, selection of successful respondents, contract awarding,and project management. NOW THEREFORE, BE IT RESOLVED that the City Commission hereby adopts the Joint Advisory Committee's finding and recommendations aforementioned. The City and County will continue to work cooperatively to implement the recommendations of the Joint Advisory Committee.
