AN ORDINANCE OF THE CITY OF BOZEMAN VACATING
A PORTION OF THE ALLEY IN BLOCK "D" OF TRACY'S
FIRST ADDITION TO BOZEMAN SO THAT THE PORTION
I SO VACATED MAY BE USED AS A DRIVEWAY TO AND
FROM THIRD AVENUE NORTH TO THE GARAGES TO BE
LOCATED IN THE REAR OF THE NEW GALLATIN COUNTY
COURTHOUSE NOW IN COUR~E OF COliBTRUCTION. '..

WHEREAS: On the 7th day of June. 1935, Gallatin County, )(ont,~, a

municipal corporation and body politic of' the State of Montana, t~ouSh it.
duly eleoted, qualified, and aoting Board of Courity Commissioners filed with
~he City Commission of the City of Bozeman, Montana, its petition in due form
praying for the vacation of a porti~n of the alley in Blook"D" of'Tracy's
First Addition to the City of' Bozeman so that the portion of said alley so
vaoated might be 'used as a driveway to and from Third Avenue North to'the
garages to be located in the rear of' thene. Gallatin County oourthouse now
in course of construction; and
WHEREAS: Thereafter on the said 7th day of' June, 1935, said petition
came regularly before the said City Commission for consideration and was by
said Commission, granted and the City Attorney instructed to pre~~re an ap-
. priate resolution declaring it to be tbe intention of said .Clty-eomIn1saion to
I grant the prayer of said petition; and ~,.......

WHEREAS: Thereafter pursuant tosuohaotion, Commission Resolution
No. 288 of the City of Bozeman was regularly passed and adopted by the City

Commission declaring it to be the intention of the City Commission to grant
the prayer of said petition, and notice thereof was duly given as required
by law, and no protests or objections of any kind having been received or
filed, oral or in writing, against said proposed action as set out in said
Commission Resolution No. 288.
NOW THEREFOR in consideration of' the prea1ses
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF BOZEMAN
Section 1
That the following described portion of the alley in Block liD" of

I, Carolyn Westlake, Clerk of the Commission of the City of Bozeman,
Montana, hereby oertify that the foregoing Ordinance No. 660 of the City
of Bozeman, was published by title in the Bozeman Daily Chronicle, a
daily newspaper of general circulation, printe4 and published in said City
of Bozeman, in the issue of July 14th, and that dueproof of said publication
was made and filed in my office.
