ORDINANCE NO. 651
AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, VACATING AND
DISCONTINUING THE ALLEY RUNNING EAST AND WEST FROM SIXTH
AVENUE TO SEVEBTH AVENUE BETWEEN COX'S BE-ARRANGEMENT OF
BLOCK THIRTEEN IN CAPITOL HILL ADDITION TO THE CITY OF
BOZEMAN, AND THE NORTH HALF OF BLOCK THIRTEEN, IN SAID
CAPITOL HILL ADDITION, AND VACATING AND DISCONTINUING
I THE ALLEY RUNNING NORTH AND SOUTH FROM WEST HARRISON
STREET TO THE ALLEY FIRST ABOVE DESCRIBED, THROUGH THE
CENTER OF SAID BLDCK THIRTEEN IN CAPITOL HILL ADDITION
TO THE CITY OF BOZEMAN.
WHEREAS, there waa filed with the Clerk of the Commission of the City of
Bozeman a petition in due form of the State of Montana, for the use and benefit
of the College of Agriculture and Mechan1c Arts, at Bozeman, Montana, and Dean
M. Hauseman and William H. McCall, praying that the alley running east and west
from Sixth Avenue to Seventh Avenue between Cox's Be-Arrangement of Block
Thirteen in Capitol Hill Addition to Bozeman, and the North Half of said Blook
Thirteen, in said Capitol Hill Addition, be vacated and discontinued, and also
that the alley running north and south from Wes, Harrison Street through the
oenter of said Block Thirteen, in Capitol Hill Addition to the alley first
above described be also vacated and discontinued; and
WHEREAS, said pet i tion was signed by the owners of all the property
abutting upon said alleys so vaoated and discontinued; and
. WHEREAS, at a regular meeting of the Commission of the City of Bozeman,
held on the 3rd day of August, 1934, said petition was considered by said
) Commission and it was deoided to grant the prayer thereof, and the City --
Attorney was instruoted to prepare an appropriate resolution declarin~ it to be

P.BE IT RESOLVED by the Commission of the Ci ty of Bozeman: -
Section 1. That it is hereby declared to be the intention of the
City of Bozeman, and the Commis.ion of said City, to vacate and disc~ntinue
the alley runn1ng east and west from Sixth Avenue to Seventh Avenue bwtween
Cox's Re-arrangement of Block Thirteen in said Captiol Hill Addition to the
City of Bozeman, and the North Half of said Block Thirteen in said Capitol
Hill Addition, and also to vacate and disoontinue the alley running north and
south from West Harrison street through the center of said Block Thirteen in
Capitol Hill Addition to the alley first above desoribed.
Section 2. That the regular meeting of said 01 ty Commission to be
held Friday, August 10th, 1934, at 7:50 o'olook P. M. of said day at the
regular meeting place of the City Commission in the City Hall of the City of
Bozeman, is the time and place when and where objections will be heard by the
granting of the petition praying for the vacation of said alleys and the -
pasaage of an ordinanoe pursuant to this resolution of intention, and the City
Manager is hereby directed to cause notice of this resolution to be serve4 upon
all persons wbose property abuts upon said alleys in said Block Thirtee~.-..and

WHEREAS, at a regular meeting of said City Commission held at the time and
plaoe specified in said resolution of intention, it appeared to the Commission
that notice of the time and place for hearing objections to the granting ot
said petition had been served and published as therein specified, as more
fully appears from the return or-the City Manager and the proof of pub1icat ion

objections having been filed to the granting thereof, and no p:l rson
app,aring in opposition thereto;
NOW, THEREFORE, BE IT ORDAINED by the Commission of the City of
BozeJj.an: I
Section 1. That the alley running east and west from Sixth Avenue to
Seventh Avenue between Cox's He-arrangement of Blook Thirteen, in Capitol
Hill Addition to the City of Bozeman, and the North Half of said Block
Thirteen in said Addition, be and the same is hereby vaaated and discon-
tinued; and also the alley running north and south from West Harrison
Street through the center of said Block Thirteen in said Capitol Hill
Addition to the alley first above described, be and the same is hereby
discontinued and vacated.
Section 2. The petitioners shall pay all costs and expenses of the
passage of this ordinance, including the costs and expenses of the neces-
sary publication or publications thereof.
Section 3. This ordinance shall become effective and be in force and
effect from and after the ~xpiration of thirty days from and after its
final passage.
