BE IT ORDAINED BY THI COMMISSION OF THE CITY OF BOZEMAN: J SECTION 1. AUTHORITY, APPLICATION AND FEES. a That under and by virtue of the power and authority vested in the ~ City at Bozeman by the provisions of Section 540g, Sectlon.5224, and sub- f divisions three, four, sixteen and fifty-four of Section 503g, as amended by Chapter 136, Laws 01' Montana, U)23 , and by Chapter 20, Laws of Montana, lQ2"i, Revised Codes of Montana, 1921, and in aid ot the po1ioe power and regulations of the said City of Bozeman, it is hereby ordained that no person, firm, association, or aorporat ion, shall conduct, operate, transact, engage in or carryon, any of the industries, trades, pursuits, professions, vocations or businesses within the City of Bozeman, hereinafter specified and enumerated, without first applying for and obtaining a license therefor trom the said City of Eozeman, as herein provided, and, if such application be granted, shall pay therefor as follows: A. All persons engaged in professional work, suoh as abstractors, .. accountants, architeots, insurance agents, dentists, doctors, realtors, 8o;lioitors, and the like, and all others performing professional servioes or giving prOfessional advice for a fee or other valuable oonaideration (except attorne'ys and counsellors at law paying a state lioense fee as proVided in Section 8945 R. MANUFACTURING ESTABLISEMENTS, CLEANING, :REPAIRING, PAINTING, PLUMBING, ELECTRIC _ING, TIN, BLACKSMITH, WOODWORKING, AND , , OTHER LIKE SHOPS. (a) Installing, repairing and/or cleaning & pressing only. No sales of merchandise at any sort. Basic License $5.00,plus $1.25 foreaoh person engaged and/or employed in the business, plus .3.50 tor each delivery or service truok. (b) Installing, Repairing, Cleani~, Pressing, Woodworking, I Manufaoturing and/or Prooessing and or Bottling Establishments (exoept Breweries) where clothing, maohinery, goods, products, merchandise of any nature whatsoever, (exoept dairy or other produots requiring speoial inspection) is cleaned, pressed, repaired, manufactured, assembled, processed, or bottles, for a tee or for sale in any manner whatsoever. Definition: Persons, associations of persons, tir.ms, oorporations, and others who, under one name, bid on and/or contract to build, remodel or repair one or more buildings, struotures or edifices, for a fixed price, or for cost, plUS a commission and/or plUS a percentage 01' cost, toturnish labor, (other than labor with his own hands) and/or materials andlor supplies, said total cost for such building or buildings and the like, being $2,000.00 or more, is for the purioses of this Ordinance, a Building Contraotor. Basic License $10.00 per year, plus 75, for each cabin. (40) Undertakers, Funeral Homes, and the like. Basic License $15.00, plus $3.50 for each ambulance or other vehiole used in the business. . (41) Vendors, other than itinerant vendors as defined in Ordinance No. 580. Selling any gOOQS, produots, m.~ehandise of any description on the streets or sidewalks or gaing trom con- sumer to consumer on streets or sidewalks. On foot, ',i.l.OO per day or $10.00 per year. From a vehicle $2.00 per day, $5.00 for 30 days, or $15.00 per year. SECTION I. INTERSTATE COMMERCE. Nothing in this ordinance oontained is intended to operate 80 I as to intertere with the power of the Congress of the Ul'lited states to regulate commerce betweeD the states. SECTION 3. DUTY OF DIRECTOR OF FINANCE - APPLICATIONS - RBlUSALS . The Direotor ot Finanoe tor the City of Bozeman shall be Oharged with the oollection of the'licenaes herein provided for, and applioation for l1cense, acoompanied by fee therefor, shall be f1;ted with him. In his discre'tion, or in the discretion Of the City K.anager, suoh applioation may be held until the next regular meeting of the City Commission following the application, when it shall be submitted to the City Commission, which may, in its discretion, decline to issue such license, 1f, in the Judgm~nt of the Commission, it will be for the best interest$ of the City of Bozeman to re~use such license. Upon suoh re- fusal the license fee paid upon application shell be returned to the applicant. The D1rector of 'Finance shall prepare all blanks for ap- plications and tor licenses; and books of acoount in connection therewith, and all expense in conneotion with the administration of this ordinance I shall, so far as is possible, be charged against the tunds oollected under this ordinance, to be segregated and deposited 'as hereinafter prOVided. All applications made under 'this ordinance, shall pear upon their face the following: "This application is made subject to all the terms and con- ~ ditions of Ordinance No. 637 ot the City of Bozeman, and this license is not transrerable"~ All licenses issued under this ordinance shall bear ..' ,,'" 393, upon their face the tollewing: "This li..nse is issued subject to all the terms and conditions ot Ordinance No. 637 and ot Application No. and this license is not transterable". SECTION 4. INSPECTION AND REGULATION UNDER POLICE POIEB. I Every person, firm, associat ion or corporat ion licensed under the provisions of this Ordinance shall be sUbject to regulation, inspection, oontrol and supervision under the general polioe power of the City of Bozeman and of all of the ordinances now in force, or whioh may hereafter be adopted, in aid of such police power and r~gulation; and each and every sueh lioense shall be subject to suspension and revooation as hereinafter provided. SECTION 5. SUSPENSION AND EKVOCATION OF LICENSES. Whenever in the judgment of the City Manager any lioense8 under this ordinance is conducting the busine.s, trade, occupation, vooation, per- formance, entertainment, or profession so licensed, in a manner whioh ~ i violates any ordinanoe, or relulatien under the general pol!ee power, of the Ci tyof Bozeman, or in any manner detrimental to the public health, morals, or welfare, he shall briefly report the facts to the Mayor, or in the absenee or inoapacity of the u.yer, to any member of the City Commission, who may there- upon suspend such license by notice to that ettect personally served ~pon the licensee, or left at his plaae ot business with the person 1n oharg. thereof. I Suoh license shall thereupon stand suspended. At the next reiular me.'tana"ot the City Cemmission, or at any speoial ...'tine called for that purposes, such suspension shall be reported to the City Oommission. The City Commission shall then have the power and authority to remove suoh suspension, continue the ~penS1on tor any period not exceeding 81%ty days, or revoka suoh 1108nae, by order entered upon the Minutes of the proceedings of the Commission, a copy of which order shall be served UpOIl th., licen..., or left at his place of business with any person in oharge thereof, and such license shall thereupon stand rellew.., suspended or revoked, as in such Qrder specified. If, when revoked' , any lioense has an unexpired period 01' si% montha or more, fifty per oent of the lioense tee collected thereunder shall be refunded to the licensee upon demand; provided, that suoh demand for ref~d muat be made within. thirty days after such revooation, or the same shall n~t be entertained. SECTION 6. UNLAWJ'UL ACTIVITIES NOT TO BB LICENSED. SEOTION 7. sEPARATE LIOENSES RBQ.UIBBD: APPEALS. When there is. any doubt abou'\elasaitication, or license fee to be pa id , or whether one or more license fees should be paid, the matter shall be reterred by the Director of J'inanoeto "he City Manager, who shal1d.aide the '" quest ion, subject to appeal to the City Commission. It suoh appeal to be ,~:... 394 taken no lioense shall be issued while the same is pending; but the applicant ~ha11 pay the fee or tees required by the City- llanager and apply to the City Commission at its next regular meeting, for any refund to which said applioant may oonsider himself entitled. No applioation for refund not made within thirty days atter paJment shall be oonsidered. SECTION e. FEES PAYABLE IN ADVANOE. PART YI.A.B?:JDS. I ':.. All licenses issued under this Ordinance shall be for ihe calendar year in whioh they are issued and shall expire Deoember 31st ot suoh year. , All fees shall be paid yearly in'advaaoe. All fees are due and pay.able' Janua,ry lstot eaoh year. A discount of 10% will be deduotedtrom all fees paid prior to March 15th ot eaoh year. Except as here~nbetore provided no discounts shall be allowed trom the tees hereinbefore ~rescribed. Provided that the fee for any lioenae tor any business, occupation or pursuit, in which the applicant, or licensee, shall first engage in such business, occupation or pursuit after lune 30th of said year and not betore in said year, shall be tunless otherwise herein specified) one balf of the fee for a full year as hereinbefore prescribed ana such license shall expire on the next succeeding December 31st. Any license issued for a specified date, time or place shall ,not be a lioense tor any other date, t~e or place. SBCTION 9. PROSECUTIONS AND' PENALTIES.-:- Prosecutions tor violation of this Ordinanoe shall be in the Police Court of the City ot Bozeman, Montana, upon written complaint ot the City Manager, Direotor ot Jinanoe, or Chief ot Police, of said City, or of any citizen of Boze~n. In addition to the fine and imprisoument hereinatter provided for violation of this ordinanee, a civil judpent for the amount of the license found due and unpaid may be entered against the defendant, if fou~d gUilty, and the same may be enforced by the 'City ot Bozeman, through its Direotor of Finance, in the manner prov1ded in s.ot~on 2241 to 2246, inclusive, Revised Codes ot Montana, 1921. S:lCTION 10. PROPERlY HELD FOR PAYMENT OF FEES. LIEN OF LICENSES. , I All property held or used in any trade, occupation, business, TGcation, pursuit or profession, tor which ~ license is required by the provisions of this ordinanoe, is liable for such lioense and subject toa lien, tor the amount thereof, which lien has precedenoe of any other lien, claim or demand, exoept liens, claims or other demands ot the United states and the state of Montana, or of either of them; and if any person fails or refuses to prooure a lioense betore the tranaaotion ot the business specitied, exoept as otherwise herein provided, the D1rector ot Finanoe 395 must se ize such property, : or ,any e'.rproperty be10ngimg to such person, association, firm or corporation, and sell the same in the manner provided in Sections 2241 to 2246, inclusive, Revised Codes of Montana, 1921. EXERCISE OF GENERAL POLICE FOWER - DISTRIBUTION OF FEES COLLECTED. It is hereby declared that the industries, pursuits, professions, ocoupations, businesses, trades and vocations required to procure licenses , under this ordinanoe require special regulation, inspeotion, control and proteotion under the general polioe power of the said City of Bozeman, and on acoount of such special service it is estimated that there is ohargeable to suoh industries, pursuits, protessions, occupations, businesses, trades and . vooations, all of the eost of administration of this ordinance; three-fourths of the health inspection, regulation and contrel of the City of Bozeman; one- fourth of the oost of the maintenance and operation of the poliee magirstate's court of the City of Bozeman; sixty-five per cent of the cost of maintenance and operation of the police department of the City of Bozeman; and forty per cent of the cost o~ maintenance and operation of the fire department of the ;,1 01ty of Bozeman. That all of the funds paid or collected under the provisions of this ordinanoe shall be depesited and kept in a separate fund of the City of Bozeman to be known as "The Froteet1en ot Life and Property Fund", and .: -. there shall also be deposited in said fund one-half of all tines and penalties oolleoted or paid into the polioe magistrate's court, one-third of all building permit tees, and one-third ot all building inspeotion tees, oolleoted by, or paid to, the City of Bozeman; and trem the money so collected, paid or deposited, shall be paid all of the expense ot the administration of this ordinance, and of the balance remaining, seven and one-half per oent shall go to the expense of the maintenanoe and operation of the health department; two . and one-half per oent shall go t. the expense of the maintenance and operat ion of the police magi.trate 'a oourt; fifty per cent shall go to the , expense of the maintenanoe and operation of the police department; and forty per cent thereof to the oost and maintenanoe of the fire department; of the City of Bozeman. Such payment shall be made from said fund to the extent that the money in such fund is available, and the balance of such expense, and any~ I deficiency, shall be paid from the tire fund of said City as to thafire department, and from the general fund of the City of Bozeman as to__the-otne-r'<~'~,- '~. . -'---"" expenses herein specified. --' _.;::<......... / ,'- P ,'-- SECTION 12. PENALTIES. Every person, firm, association, or oorporation, and the agent's, servants or employees of suchpersGn, f1r.m, association or corporation, con- duoting, operating, transaoting, engaging in, or oarry1ng en, any at the industries, pursuits, professions, occupat1oDS,' vocations, en te rta inmen t s , '. l;,~~ .< 396 shows or businesses, specffied or enumerated in this ordinance, without first procuring the license therefor as herein required, shall be deemed guilty of a viol~tion of .this ordinance, and upon oonviction thereot in the police court ot the City of Bozeman shall be fined not less than Five Dollars nor more than Two Hundred Dollars, or by imprisonment in the City or County Jail I for not less than one day, nor more than ninety days, or by both such tine and 1m.prisomnent;. prOVided, that if any such fine so Unposed be not paid it 'hall be satisfied by the person upon whom it is i~po8ed by imprisonment in the city or county jail at the rate of one da7~s imprisonment for each Two DOllars of such fine. Any prosecution, oonviction and puni.bme~t under this section shall not relieve from payment of the license required, but the same must also be paid, and may be colleote4 by the means and in the manner elsewhere in this ordinance provided. SECTION 13. REPEALS. Ordinances Nos. 494, 506, 535 and 554, and 581, at the City of Bozeman, and all ordinances and parts of ordinances in oonflict with the provisions of this ordinance, are hereby repealed. Provided, that this provision for the repeal of Ordinance No. 581 shall not deprive the City of Bozeman from enforcing by suits now pending the collection of any license due the City of Bozeman under said Ordinance No. 5~ or pro- secutions now pending for violations of said Ordinance No. 581. I SECTION 14. CONSTITUTIONALITY. It any provision of this Ordinance shall be held to be in contra- .. vention of the Constitution of the United States, or of the state of Montana, or invalid tor any reason, the invalidity of such provision shall in no manner ettect the other provisions of this ordinance,but every other sect ion and every other provis'ion shall be upheld as the legislative will of the City of Bozeman, Montana, to the same extent as it such unoon- stitutional or inYalid provision bad not been a part of this ordinance. / SECTION 15. ElTECT. That this Ordinance shall be in full force and effeot from and after thirty days after its passage.
