AN ORDINANCE OF THE CITY OF BOZEMAN VACATING AND DISCONTINUING
THE ALLEY RUNNING EAST AND WEST BEl'wuN WALLACE AVENUE AND IDA
AVENUE IN BLOCK 105 OF NORTHERN PACIFIC ADDITION TO THE CITY
OF BOZEloJIAN.
I WHEREAS there was filed with the Clerk of the Commission of the City
of Bozeman, a petition in due form of Northern Pacific Railway Company, a Wis-
consin Corporation, requesting that the alley in Blook 105 of Northern Paoific
Addition to Bozeman running East and West between Wallace Avenue "and I~a Avenue

WHEREAS said petition was signed by the owner of all th.:.-ep~~y

abutting upon said alley so requested to be vaoated and d iscontiuUctcI';>alld

WHEREAS at a regular meeting of the said Commission of the City of
Bozeman held on the 16th day of Deoember, 1932. said petition was considered
by said Commission, and it was deoided to grant the prayer thereof. and the
City Attorney was instructed to prepare an appropriate resolution declaring
it to be the intention of said City to grant the prayer of said petition
under the procedure provided by law; and
WHEREAS the said City Attorney upon said date and at said meeting
presente. the following resolution of intention, to-wit:
"BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZ~~:
Section 1. That it is hereby declared to be the intention of the
I City of Bozeman, and the Commission ot said City, to vacate and discontinue
the alley in Block 105 of Northern Paoific Addition to the City of Bozeman,
which alley runs east and west through s.~ Blook between Wallace Avenue
and Ida Avenue in said City.
Section 2. That the regular meeting of said City Commission to be
held Friday, December 23rd, 1932, at 7:30 o'olook P. M. of said day,at th~
regular meeting plaoe of the City Comm.isaionin the City liall of the City,
of Bozeman, is the time and place when an4 where objection will be heard
to the granting of said petition and the ~aS8age of an ordinanoe pursuant-
to this resolution of intention, and the ity Manager is hereby directed
to cause notice of this resolution to be served upon all persons whose
property abuts upon said alley in said Block 105 of sa i4 Northern Pac ifio
Addition to said City of Bozeman proposed to be vacated and discontinued,
and to give notioe thereof by publication, all in the manner and fo nn as
provided by Seotion 5494, R.C,M., 1921.-
Whioh resolution was then and there unanimously adopted by said ~
Commission; and

NOW, THEREFORE, BE ITORDAlNED BY THE Crnw~ISSION OF THE CITY OF
BOZEMAN:

Section 1. That the alley in Block 105 Qf Northern Pacific Addition
to the City ot Bozeman running east and west between Wallaoe Avenue and Ida
., Avenue be and the same is hereby disoeAt~~u.d andvaoated.
Sect ion 2. The Railway Company shall pay all ooste and expenses of

force from and after the expiration of thirty days from and after its
final passage. I
