'Q AN ORDINANCE REGULATING AND CONTROLLING THE DISCHARGE
OR FIRING OF FIREWORKS, FIRECRACI\ERS AND OTHER PYRO-
TECHNIC AND EXPLOSIVE DISPLAY OR DEMONSTRATION, AND
REGULATING THE SALE OF SUCH EXPLOSIVES, WITHIN THE
CITY OF BOZ~Uili. .
WHEREAS, it is necessary, for the satety, peace and quiet of the I
City of Bozeman and the inhabitants thereof, that the discharge or firing ~ ' '.
of fireworks, firecrackers, and other pyrotechni'c and explosive display or-o, <',

gulated and controlled, therefore, -
BE IT ORDAINED BY 'l'HE COM1USSION OF THE CITY OF BOZEMAN:
Section 1.
SALE, DISCHARGE AND USE PROHIBITED.
Except as in this Ordinance otherwise provided, the sale at retail,
discharge, firing or use of firecrackers, rockets, torpedoes, Roman candles,
or other fireworks or substances designed or intended for pyrotechnic dis-
play or demonstration, and of pistols, canes, cannons, or other appliances
using gunpowder, blank cartridges, or caps contain~ng chlorate of potash
mixture, within the City of Bozeman, is hereby prohibited. Provided, that
the Director of Public Safety of the City may, at any time, in writing, per-
mit a public display of fireworks under such conditions, limitations and
precautions as he may prescribe and by properly qualified persons, with due I.........~..'
regard to the safety of persons and property. . .:
Section 2.
EXCEPTION.

proper regard for the safety of persons and property, and this permission
shall not be construed, and is not intended, to permit or authorize any reck-
.,less, n~gligent or careless use or discharge of any of the articles described
in Section 1 of this Ordinanoe, or of any similar article or explosive, at any
time.
Section 3.
REMOVAL OF STOCK
The Director of Public Safety may, at his discretion, remove or
have removed, at the owner's expense, all stocks of fireworks and articles
specified in Section 1 of this Ordinance" and an.y similar article or combus-
tible, exposed for sale or held in .st.OCk. in violat ion of this Ordinance. I" .
Section 4.
PENAll.TY.
Any person, firm, corporation or association violating the pro-
visions of this Ordinance shall be punished by a fine of not less than Five
Dollars ($5.00), nor more than Three Hundred Dollars (.300.00), or by im-
prisonment in the county or city jail for not less than one day nor more
than thirty days, or by both suoh fine and imprisonment; and in case of

violation by any firm, corporation or association, the manager or other.pe.r.~on

in charge shall, prima facie, be held responsible and be pWlished ashe~ein pro-
vided.
Section 5.
REPEAL .
I. Ordinance No. 2~9 of the City of Bozeman, entitled,
"AN ORDINANCE PROHIBITING THE USE AND SALE OF GIA~
FIRECRACKERS AND DYNAMITE-CANES WITHIN THE LIMITS
OF THE CITY OF BOZ1F.MA'N,"
and all other ordinances and parts of ordinances in oonfliot herewith are hereby
repealed.
Sect ion 6.
EFFECTIVE DATE
This Ordinance shall be in full force and effect from and after thirty
(30) days after its adoption.

on the 29th day of August, 1932.
