WHEREAS: I (1) HUGH STALLINGS and EUGENE GRAF filed with the Commission of the City of Bozeman, on the 4th day of September, 1931, a peti t'iO,n re~\l.est- , ing Ci;hat the alley in Block"l!07" , Northern Pacific Add it ion to the CitY"of- , - -- .. , Bozeman, ve vacated, for the use and benefit of the said Hugh St!3-1)..i'n~}t'~.l~J. Eugene Graf, and setting forth, among other things, that said BloOk'C"L07" is owned and held as follows: Hugh Stallings, Lots Twenty_Eight (2S) to Thirty-two (32), and Eugene Graf, Lots 9ne (1) to Twenty-seven (27); . and (2 ) On the 11th day of September, 1931, at a regular session of . the Commission of the City of Bozeman, Commission Resolution No. 222 entitled: "A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DECLARING IT THE INTENTION OF THE CITY OF BOZllMAN TO VACATE THE .ALLEY IN BLOCK "107", NORTHERN PACIFIC ADDITION TO THE CIT1 OF BOZEMAN" was passed and adopted; and . (3) "Notioe in re COMMISSION RESOLurION NO. 222, A RESOLUTION I OF THE COMMISSION OF THE CITY OF BOZEMAN DECLARING IT THE INTEHTION OF THE CITY OF BOZEMAN TO VACATE THE ALLEY IN BLOCK ,- "107", NORTHERN P.Ama:FFC ADDITION TO THE CITY OF BOZEMAN" was served on the 15th day of September, 1931, in the manner that servioe of SUID!llons is required to be made in civil actions on persons affected by the preposed vacation, to wit: . (a) Hugh Stallings, (b) Eugene Graf, by admission of service by the said Hugh Stallings and Eugene Graf; and (4) The City Manager of the City of Bozeman did cause Notice of said Resolution, as aforesaid, to be given as required by law by pub- ,~ . lication in the Bozeman Daily Chronicle, a daily newspaper of general, ,-- ... oircu1ation, printed and published in the City of Bozeman, County of . - ... .. .'~......- Gallatin, State of Montana, on TueSday, the 15th day of September, 1~31',.,.-_.._.::-~~c , " ..... '. which Notioe, so served by admission of service, and published, as afore- said, atated the time and place, to wit, Friday, the 9th day of October, , 1931, at 4:00 o'olock P. M., at the Commission Chamber in the City-Hall, Bozeman, Montana, as the time and plaoe for hearing objections to the I vaoation of said alley, and the passage of an Ordinance by the City of .ozaman vaoating the same, when and where all persons whose property abuts on the portion of the alley affected by the pro,posed vaoation may appear ~ \ and show cause, if any they have, why an Ordinance should not be passEld vaoating said alley in said Block "107", Northern Pacific Addition; and ...........'.. That the alley in Block "107", Northern Pacific Addition to the City of Bozeman, be, and the same is hereby, vacated and d iscont inued. Seotion 2. That this vacation is had and made pursuant to I the provisions of paragraph six, Section 5039, Section 5306, as amended .. by Chapter 13, Laws of Montana, 1929, and Section 5494, Political Code, R.C.M., 1921; Section 3. That this Ordinance shall be in full force and effect from and after thirty days from ~he date Of' its final passage by the Commission; Sect ion 4.
