AN ORDINANCE OF TEE COMMISSION OF THE CITY OF BOZEMAN PROVIDING FOR THE SALE AND ISSUANCE OF REFUNDING CITY BONDS OF THE CITY OF BOZEMAN IN THE AMOUNT OF $109,000.00, TO BEAR DATE, JANUARY 12th, 1931, AND TO BE ISSUED FOR THE PUR- POSE OF REDEEMING OUTSTANDING FUNDING BONDS OF THE CITY OF BOZEMAN IN THE AMOUNT OF:~109 ,000 .00. ,'\ \ I WHEREAS: I. The Oity of Bozeman has outstanding valid, optional Eunding Bonds in the sum of $109,000.00, bearing interest at the rate of five per oent per annum, issued by said 0ity under and by virtue of the provisions of Ordinano~ No. 443, entitled: "AN ORDINANCE DIRECTING THE ISSUANCE OF TeE FUNDING BONDS OF THE CITY OF BOZ>>IAN, MONTANA, TO THE .AMOUNT OF $170,000.00 TO FUND THE EXISTING INDEBTEDNESS OF THE SAID CITY AND AUTHORIZING AND DlRECTIW THE CITY TREASURER TO EXCHANGE THE FUNDING BONDS FOR THE OUTSTANDnG WARRANTS OF SAID CITyn, and Ordinance No. 444, entitled: "AN ORDINANCE DIRECTING THE FORM OF THE FUNDING BONDS OF THE CI TY OF BOZEMAN"; and II. On the 24th day of Ootober, 1930, the Commission of the 0ity of Bozeman passed and adopted Commission Resolution No. 205, entitled: "A RESOLtJrION OF THE COMMISSION OF THE CITY'OF BOZEMAN DIRECTING THE CITY MANAGER TO TAKE THE NECESSARY LEGAL STEPS TO PROVIDE FOR THE ISSUANCE AND SALE OF, $109,000.00 OF REFUNDI NG eI TY BONDS TO REFUND OUT STANDING WARRANT I FUNDING BONDS"; and III. !ursuant to said Resolution. so passed and adopted, as aforesaid. due and legal notioe of the sale of said Refunding City-BondS was made and given, as requir,ed by law, ani :proof thereof has been made and filed with the Clerk of said Commission; and IV. At the time and place designated for reoeiving bids for the purohase of said Refunding City Bonds, to wit, at a regular session of the Commission of the City of Bozeman held on the 28th day of November. 1930, the State Board of Land "'ommissioners of the State of Montana SUb- mitted a bid for the purohase of the entire issue of said Refunding City Bonds in the amount of tl09,OOO.00, at par, and the fommission at that time aooepted the bid of the State Doard of Land Commissioners, subJeot to the right of the Commission to purohase a bond, or bonds, in the amount not to exoeed $9,000.00; and v. At a regular session of the Commission of the City of Bozeman held on the 5th day of Deoember, 1930, it was ordered that the ~ity of t ., Bo zeman, by and through its Sinking ~'und '.I.'rus tees for the 'benefi t of the "n._..r_ ~ Permanent Care Fund of Sunset HillsCeJll8tery, purchase a bond of said issue of said Refunding City Bond s in the'aDlount of ,~2 ,000.00 and that a. bond of said issue of rtefunding City Bonds, in the amount of $107,000.00, be issued and sold to 'the State Board of Land Commissioners, pursuant to its bid; and that a bond of said issue of said Refunding City Bonds in the amount of $2,000.00 be sold and issued to the City of Bozeman, by and through 252 its Sinking Fund Trustees for the benefit of the Permanent Care Fund of Sunset Hills Cemetery; am that said .nefunding City Bonds, so sold and issued, be payable on the amortization plan, bearir~ interest at the rate of 4t per cent per annum and payable in equal semi-annual install- I ments of principal and interest during a period of eighteen years from da t e; and VI. Pursuant to the provisions of said Ordinance No. 443 and No. 444, passed as aforesaid, the City of Bozeman has exercised its right to redeem the outstanding Funding Boms in the sum of $109,000.00, and said outstanding Funding Bonds in the sum of ~109,OOO.OO have been called for redemption on the 1st day of January, 1931; and VII. The issuance of said nefunding City Bonds will effect a substantial saving to the City, of Bozeman by reason of the reduced rate of interest and will be of financial benefi t to 'the sa,id Ci ty, and will in other respects be advantageous to the said Ci ty; NOW THEREFORE, BE IT ,ORDAINED BY THE C0M11ISSION OF THE CITY OF BO ZEMAN : Section 1. ~hat under and by virtue of the provisions of , Section 5288, Political Code, R.C.M. 1921, the City 'of Bozeman, County . of Gallatin, state of Montana, shall issue in the name of the City of I Bozeman two Refunding City Bonds in the aggregate amount of '~lO9,OOO.00, , the first, or No.1, in the amount of ~l07,000.OO, and the second, or No.2, in the amount of $2,000.00; for the purpose of refunding and redeeming said issue. of $109,000.00 of the outstanding optional Funding Bonds of the said City of Bozeman; that said bonds, so issued, shall be payable on the amortization plan, and the moneys derived from the sale of said two Refunding City Bonds shall be used for the purpose of redeeming outstanding Funding Bonds in the sum of $109,000.00; the. t said bonds shall be designated "REFUNDING CITY BONDS"; that Bond No. 1 shall be in the denomination of ,;plO? ,000.00 and Bom No.2 shall be in the dElnomination of~2,OOO.OQ; that both bonds shall be dated January 12th, 1931, and payable in equal semi-annual installment s or principal and interest during a period of eighteen years from date, and shall be redeemable at any time 'after fifteen years from date at the option of the City of Bozeman; that said bonds shall bear interest at the rate of 4t . percent per annum, and the amortized payments of both prineipal and I interest on bond No.1 for ~107,OOO.OO shall be payable at the office of the State Treasurer of the State of Montana at the Capitel of the State, Helena, Montana, and the amortized payments of both principal and interest on Dond No.2 for $2,000.00 shall be payable at the office of the Director of ,Finance of the ~ity of .Bozeman, Bozeman, Montana; that said bonds shall be signed by the Mayor and (;lerk of the Commission of the City of Bozeman; .n. ____.. -~.__._.._.'------..,.....~._.__.'.'._. That when said R~fundi~ City Bonds Nos. 1 and 2, for the sums of $107,000.00 and $2,000.00 respeotively, have been pre- pared and exeouted and the said Board of Land Commissioners of the State of Montana has paid to the City of Bozeman the sum of ~l07,OOO.OO, and the Sinking Fund Trustees, for and on behalf of the Permanent Care Fund of Sunset Hills Cemetery, has paid to the Director of Finance of the '\;ity of Bozeman the sum of $2,000.00, then and'thereupon the said bonds shall be delivered to the said Board of Land Commissioners and to the "Sinking Fund Trustees respectively; and the moneys derived therefrom, 'to wit, ~109,800.00, anall be ueed in paying and redeeming the Funding Bonds in'the sum'of ~109,OOO.00, herein referred to, and thereupon, said -Funding Bonds in said ameuntof 9109,000.00 shall be oanoelled and destroyed; .
