~~ ORDINANCE REPEALING ORDINANCE NO. 409 ENTITLED:
"AN ORDINANCE GRANTING TO CARL SCHROETER OF CHICAGO, ILLINOIS,
AND J. C. MC CARTHY OF BOZ~UN, MONTANA, AND'TO THEIR ASSIGNS,
THE RIGHT TO CONSTRUCT, 1L~INTAIN AND OPERATE A PLANT FOR THE
MANUFACTURE, SALE AND DISTRIBUTION OF ILLUMINATION AND FUEE GAS,
AND THEIR BY-PRODUCTS, AND TO USE THE STREETS, AVEIIDES, ALLEYS I
AND PUBLIC pLACES OF THE CITY OF BOZEMAN FOR THE LAYING DOWN OF
GAS MAINS AND SERVICE PIPES, AND PROVIDING AND FIXInG A MAXU'IUM
RATE TO BE CHARGED FOR GAS, AND PROVIDING THE CONSIDERATION TO
BE PAID FOR SUCH PRIVILEGES."
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF BOZEMAN:
Sec. l. That Ordinance No. 409 entitled:

THE RIGHT TO CONSTRUCT, MAlNTAIN, AND OPERATE A PLANT FOR THE
MANUFACTU1lE, SALE AND DISTRIBUT ION OF ILLUMINATIBG AND FUEL
GAS, AIm THEIR BY-PRODUCTS, AND TO USE TH~!: STREETS, AVENUES,
ALL EYS AND PUi3LI C PLACES OF THE CI TY OF BOZEMAN FOR THE LAYING

be and the same is hereb;)' repealed.
Sec. 2. That Ordinance No. 409 is repealed for the reason that it never became
operative, that the grant of the franchise therein contained is null and void.
Sec. 3._ That all ordinances and parts of ordinances in conflict herewith
are hereby repea~ed.
Sec. 4. That this ordinance shall be in full for~e and effect from and
after thirty days after its final passage.

Commission of the City of Bozeman heldon the 4t/day of October, 1929; final passage '.
of ordinance fixed for a regular session of the \commission of the City of Bozeman
to be held on the lIth day of October, 1929.
Finally passed by the Commission of the City of Bozeman, at a regular session
thereof held on the 11th day of October, 1929.
