Additional Materials 15-233 ZC CC Summary Memo Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Tom Rogers, Senior Planner Wendy Thomas, Director of Community Development SUBJECT: Zoning Commission Report; Stucky Road Zone Map Amendment Application, 15-233 MEETING DATE: July 27, 2015 AGENDA ITEM TYPE: Action RECOMMENDATION: Include Zoning Commission summary of discussion review. BACKGROUND: This is an application to establish municipal zoning designation in conjunction with a request for annexation (Application 15-232) on a 20.62 acre parcel in the southwest quadrant of the City. On July 21, 2015 the Zoning Commission considered the application. Sixteen members of the public provided oral testimony on the zoning application. Fourteen comments were opposed, one was supportive, and one suggested that a lesser intense classification would be more appropriate. A complete discussion is available through the City video archive. Public comment focused on the following issues:  Physical access to the site  Safety of the current transportation network  Cost of community services  Conversion of productive agricultural lands to residential use  Impacts on adjacent agricultural lands  Perceived sprawl and leapfrog annexation  Distance to MSU will dictate most trips will rely on vehicular travel  Difficulty to improve Stucky Road with high ground water and clay  Transition from high density residential to ag land  Character of the district is currently agricultural and high density residential is contrary  Reactive planning  Stucky Road has historically and remains a farm to market road  County and City should work together to accommodate development  Infrastructure improvement should be completed before development  R-3 is more appropriate than R-4 on this parcel A motion made and seconded to approve the zone map amendment. The majority found the proposed zoning did not overcome the burden of proof showing the promotion of public, public safety, and general welfare, did not facilitate the provisions of transportation, water, sewerage, schools, parks and other public requirements, or the character of the district. On the other hand, the dissenting vote found that the proposed zoning did promote the aforementioned and was in conformance with the growth policy and the current character of the district is temporal. In conclusion the Commission voted 1:2 to approve the motion. The motion failed. The July 21, 2015 Zoning Commission discussion can be viewed HERE.
