MEETING DATE: July 27, 2015 AGENDA ITEM TYPE: Consent RECOMMENDATION: Approve a Special Permit for the Sweet Pea/A Festival of the Arts of Bozeman, Montana to sell Beer and Wine at Lindley Park, 900 E Main Street from August 7, 2015 through August 10, 2015. BACKGROUND: 4.02.050. Special Permits A. The city commission, in its discretion and upon application, may grant a special permit to sell beer or wine for consumption on the premises to the following: 1. Any association or corporation conducting a picnic, convention, fair, civic or community enterprise or sporting event within the city limits; 2. A nonprofit arts organization, organized and operated for the principal purpose of providing artistic or cultural exhibitions, presentations, or performances for viewing or attendance by the general public, to be served at an exhibition, production, performance or program for on-premises consumption; and 3. Any other organization or for any other reason the city commission, in its discretion, determines should be allowed to serve or sell alcohol during a function. B. The application for a special permit shall be granted only upon the organization acquiring a special permit from the state as provided in the Montana Alcoholic Beverage Code. The applicant must specify the location and nature of the event and the period it is scheduled to be held. All applications will be signed by one or more of the association's officers, will be notarized and will be accompanied by the amount of the permit fee. The permit issued under this section will not authorize the sale of beer or wine for a longer period than one day before the event is scheduled to begin and one day after the event has been concluded. The applicant has obtained a Special Permit from the Montana Liquor Control Board (Special Permit 1438). FISCAL EFFECTS: None 101 ALTERNATIVES: As suggested by the City Commission. All guests under 40 willbe asked for I.D and wrist banded prior to entering the Beer & Wine Garden.Guests without I.D. will not be admitted or served. Security and bar staff aretrained to watch for drinks being passed to minors by those over 21 and willinstitute a one drink per person policy if we feel drinks may be passed off.• Alcohol will not be permitted outside of the designated Beer & Wine Garden.• There will be signage posted at the entrance and exit to the Beer & Wine Gardenstating that there is no alcohol permitted beyond the parameters of the Beer &Wine Garden.• All alcohol served on premise will be provided and served by TIPS certifiedSweet Pea volunteers and Dark Horse Productions staff.• We feel that the best way to handle guests who are under the influence is toprevent over service before it happens by slowing down the speed at which aguest is drinking, suggesting food or water and, when necessary refusing servicealtogether. In the event that a guest appears to have over imbibed our staff isempowered to call them a taxi at the expense of Dark Horse Productions.• Because people are still new to the idea of a Sweet Pea Beer & Wine Garden weanticipate a certain number of guests who will arrive having "pre partied" beforeentering Lindley Park. For this reason guests who appear to have over imbibedoff site will be denied entry to the Beer & Wine Garden.• Sweet Pea Volunteers and Dark Horse Productions staff are strictly prohibitedfrom consuming alcohol while on shift.• Last call will be done thirty minutes before the end of each day's finalperformance.• Last year we had two Bozeman Police Department officers on site in Lindley Parkthroughout the weekend as well as Rocky Mountain Security officers on footpatrol and we are hiring an additional four Crowd Management Services staff tohandle Beer & Wine Garden specific security and ID checking.• Emergency situations will be handled by calling 911.104
