Resolution 4618, Bozeman Pond Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Carolyn Poissant – Manager of Trails, Open Space, and Park Development Mitch Overton – Director of Parks and Recreation SUBJECT: Approval of Bozeman Pond Park Expansion Master Plan and Additional Funding Allocation for Initial Park Project Construction MEETING DATE: July 27, 2015 AGENDA ITEM TYPE: Action RECOMMENDATION: Approve Resolution 4618, in order to: 1) approve the Bozeman Pond Park Expansion Project Master Plan; and 2) authorize additional funding in the amount of $105,000 from the Trails, Open Space, and Parks (“TOP”) bond fund premium revenues for construction of the paved, stubbed portion of Pond Row, gravel access drive, and gravel parking lot and associated infrastructure improvements as part of the Bozeman Pond Park Expansion Project SUGGESTED MOTION: In consideration of all public input and information received to date: I hereby move to approve Resolution 4618, in order to: 1) approve the Bozeman Pond Park Expansion Project Master Plan as presented by staff and approved by City Commission on June 8, 2015; and 2) authorize additional funding in the amount of up to $105,000 from the Trails, Open Space, and Parks Bond Fund premium revenues for construction of the paved, stubbed portion of Pond Row, gravel access drive, and gravel parking lot and associated infrastructure improvements as part of the Bozeman Pond Park Expansion Project. BACKGROUND: Resolution No. 4494 approved the allocation of Trails, Open Space and Parks (TOP) bond funding in an amount not to exceed $1,045,000 for the acquisition of park land and development of the Bozeman Pond Park Expansion Project (“Project”). Resolution 4494 states the primary goals of the Project are to include: 1) a 5-acre natural park between the existing Bozeman Pond Park and Ravalli Road; 2) a 3.5 –acre off-leash dog exercise area; 3) a paved, shared-use path paralleling Fowler and natural surface trails that offer recreational opportunities, provide access to park amenities, and create alternative transportation routes to community facilities; and 4) a restroom and 5) a 50-car parking lot to serve the park, dog area, and nearby Aasheim Ball Fields (adjacent to Hyalite Elementary school). ). A conceptual plan (Attachment A) was provided as part of the TOP application, which was further refined during the public input process to develop a master plan including all of the items specified in the resolution (Attachment 105 B). The Master Plan for the park includes all of the features shown on the conceptual plan, with the parking lot indicated as a future phase. Specifically, the proposed park elements include: • Three picnic / shade shelters • 2.1-acre fenced off-leash dog park • Outdoor classroom with natural play area • Pre-fabricated restroom building • 10-ft wide paved, multi-use path along Fowler (connecting to the existing near Huffine) • Gravel fines accessible trails connecting park features • Park benches, waste receptacles, and park entry sign • Park landscaping and irrigation • Paved “stubbed” park entry off Fowler with sidewalk connections • Gravel access drive and parking lot The Recreation and Parks Advisory Board approved the proposed Bozeman Pond Park Expansion Master Plan on April 9, 2015. Their motion included the following recommendations: 1) Complete a first phase of Pond Row road and infrastructure improvements until HAVEN is ready to build by paving from the park entry at Ravalli to the east end of the parking lot; 2) Install a gravel parking lot without curbing; and 3) Provide an easement for the Hearts and Homes well and backyard fence. At the Bozeman City Commission meeting of June 8, 2015, a motion by Commissioner Mehl was passed unanimously to “approve the Bozeman Pond Park Expansion Project Master Plan as presented by staff.” Under the next agenda item, a motion by Commissioner Mehl was passed by a vote of 3-2 to “approve the allocation of funding for the construction of the stubbed gravel Pond Row and parking lot and associated infrastructure improvements in the amount of up to $105,000 from the Trails, Open Space, and Parks bond premium revenues. To clarify, at this time, the park entryway will be paved as a full local street section up to the multi-use trail crosswalk (“stubbed Pond Row”), the access drive and parking lot will be gravel and curbed, with future paving to be completed when appropriate and as funding becomes available. This will require two timing variances for Pond Row and parking lot paving, meaning the required improvements will be provided at a later date. The code-required parking lot landscaping is intended to be provided during the initial park construction, budget permitting. The required watercourse setback landscaping will also be deferred until a later date in order to coordinate with future development to the east (the HAVEN site) as well as the construction of additional Pond Row improvements. This will also require a timing variance. It is more efficient to extend irrigation and install landscaping when Pond Row improvements and the site plan for HAVEN are completed. The existing pond outflow creek (the subject watercourse) needs to be re- aligned and substantial grading and restoration work needs to occur for the road culvert installation and design of HAVEN’s access points, as well as connectivity to the park. A timing variance for the construction of Fowler Road improvements will also be required. The Public Works Department supports the variance as additional right-of-way needs to be secured before the full segment of Fowler Road from Huffine to Babcock can be constructed. The proposed paved, multi-use path and park improvements are located outside of the existing 100- foot Fowler right-of-way. The site plan for the initial phase of park construction will go through DRC review and be brought back to Commission due to the need for the four timing variances. The estimated 106 construction schedule is September – October 2015 with additional work by partners and volunteers (for the dog park, trails, and playground). The project is expected to be completed by November 1, 2015. City engineering, community development, and parks department staff will continue to hold project status meetings to ensure that road and infrastructure design and construction in city rights-of-way surrounding the park, as well as improvements on adjacent properties being developed, are well coordinated. UNRESOLVED ISSUES: An easement for access to an existing well needs to be granted to the property owner to the north (Hearts and Homes of Help Center, Inc.). We are also working with the Hearts and Homes staff and board to create an easement to allow extension of the paved trail along the west edge of the dog park with a possible mid-block crossing to the Aasheim ballfields, in exchange for allowing the backyard fence and play equipment to remain in an easement on park property. ALTERNATIVES: Per Commission. FISCAL EFFECTS: The Agreement will allow the project to proceed and be in conformance with all City land use development code requirements. The Commission hereby approves and adopts the Bozeman Pond Park Expansion Master Plan (“Exhibit A”), which satisfies all of the primary goals of the Project as delineated in Section 3 of Resolution 4494, with the exception of providing a parking lot for 18 cars instead of 50 cars. Section 2 Funding / Authority. The Commission hereby authorizes additional funding in the amount of $105,000 from the 2015 balance of the Trails, Open Space and Parks Bond premium revenues to cover the design and construction of site improvements for Phase I of the Bozeman Pond Park Expansion Master Plan, which includes a paved park entry connecting to a gravel access drive and gravel parking lot. Section 3 Amendment to Resolution 4494.
