Southbridge Final Plat1 REPORT TO: Honorable Mayor and City Commission FROM: Tim Cooper, Assistant City Attorney Wendy Thomas, Director of Community Development SUBJECT: Authorize the Director of Public Works to approve the Southbridge Phase 4 Subdivision Final Plat, Application P15260 MEETING DATE: July 20, 2015 AGENDA ITEM TYPE: Consent RECOMMENDATION: That the City Commission approve the Final Plat for the Southbridge Phase 4 Major Subdivision Final Plat, Application P15260 and authorize the Director of Public Works to execute the same on behalf of the City of Bozeman upon review and approval by the City Attorney’s Office. BACKGROUND: On July 14, 2014, the City Commission approved the findings of fact completing the preliminary plat approval to subdivide 24.255 acres to create sixty-nine (69) single-household residential lots, five (5) open space lots, one (1) park, and streets. The developer has applied for final plat review and approval for Southbridge Phase 4 subdivision. The preliminary plat was unanimously approved (5:0) by the City Commission on September 8, 2014. Staff has concluded that all terms and conditions of the preliminary plat approval have been met. An improvements agreement has been completed for the future installation of sidewalks, park improvements, and completion of seeding. The appropriate financial guarantee has been received. UNRESOLVED ISSUES: None determined at this time. ALTERNATIVES: 1) Approve the final plat as presented and recommended. 2) Deny the final plat. FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased property tax revenues from new development, along with increased costs to deliver municipal services to the property. P15260 DATE: JULY 7, 2015 Madison Engineering, on behalf of Southbridge Development (Applicant), has made application to the City of Bozeman Department of Community Development for Final Plat review and approval for the Southbridge Phase 4 Major Subdivision, a 36 lot subdivision. Southbridge Phase 4 will plat the remaining area within Southbridge Phase 2 (formally Meadow Creek Phase 2) and a portion of Southbridge Major Subdivision which was granted preliminary plat approval to subdivide 24.255 acres to create sixty-nine (69) single-household residential lots, five (5) open space lots, one (1) park, and streets. Attached is a copy of the signed Findings of Fact and Order dated September 8, 2014. The Findings of Fact and Order for Southbridge Phase 2 (Meadow Creek Phase 2) dated November 6, 2006. Improvement Agreements are required for this subdivision for the installation of sidewalks and park seeding and boulevard landscaping. All other necessary infrastructure improvements are constructed. Based on the summary review provided below the Development Review Committee, the City Engineering’s Department and Department of Community Development have reviewed the application against the conditions of preliminary plat approval; and as a result, find that the final plat application may be approved by the City Commission. Three (3) original mylars of the Final Plat, original Platting Certificate, copy of the property owner association documents and a copy of the Findings of Fact and Order are attached for your review. The property owner’s association documents and other applicable documents will be recorded and filed with the final plat at the Clerk and Recorder’s Office. The Community Development staff respectfully requests that you prepare a City Attorney's Certificate using the attached original Platting Certificate; approve the Certificates of Director of Public Works and Certificate of Completion "as to form". The final City signatures will be obtained once the City Commission has approved the final plat. An application was submitted to the Community Development Department on May 18, 2015 and amended on June 4 and July 2, 2015. Based on the applicant having submitted a complete application on July 2, 2015 for final plat review and approval, and further finding that after receiving supplemental 10 Page 2 information (Parkland Deed, Findings of Fact for Southbridge Phase 2), Improvement Agreement Application, fees, payment for cash-in-lieu of water payment, and bonding mechanism the application was deemed complete on July 2, 2015, the 45-day (working days) review period for this final plat would expire on September 4, 2015. The conditions of preliminary plat approval, which are pertinent to this major subdivision and how they have been met are described in the submittal materials. Two exceptions to this are that it was determined that a subdivision improvements agreements are required for uninstalled sidewalks and open space and boulevard landscaping. We have those agreements in hand and the financial guarantee was provided by irrevocable standby Letter of Credit No. 2015531127 and 2015531126 from First Interstate Bank, 2800 West Main Street, P.O. Box 1890, Bozeman, MT 59771. Note: The Community Development Department and Engineering Departments have also reviewed the final plat application against the preliminary plat cited code provisions and found compliance with these code requirements. The Engineering Department has also reviewed and approved the “closure” of the final plat.
