HHEREAS, at a regular session of the Commission of the City of Bozeman, State of Montana, I held on the 18th day of December, 1968, the said Commission duly passed Commission Resolution No. 1.396 declaring it to be the intention of the said Commission to create a special improvement district to be known and designated as Special Improvement District No. 491 of the said City for the purpose of operating and maintaining a street lighting system to light Main Street (U.S.High- way 10) bet\'lecn the Centerline of Buttom.;rood Avenue and Highway Station 21+50.8 being the end of Main Street highway construction and beginning of Interstate 90, said lighting system to be installed and paid for by the State llighway Commission of the State of Montana, all under the authority of and in conformity \.;rith Sections 11-22!fS and 11-2257, inclusive, of the Revised Codes of Montana, 1947, which said Resolution of Intention is of record and on file in the office of the Clerk of said City Commission and open to the inspection of the public, and is hereby referred to for fur- ther particulars; and. HHEREAS, due proof has been made that service of notice of the adoption of said Resolution No. 139F was duly made and given as by law provided; and, \'JHEPJ~AS , at the time and place fixed in said Resolution No. 1396 for the making and filing I of protests against the creation of said proposed Special Improvement Lighting District No. (+ 91 , to-wit, at the hour of 1:00 o'clock, p.m. on \.]ednesday, the 15th day of January, 1 9fi 9, be in g a regular meeting time of said City Commission, at the Commi ss ion Chamber in the City Hall Build ing of the City of Bozeman, there were not sufficient protests made or filed against the creation of said Special Improvement Lighting District No. 491. NOH, THEREFORE, BE IT RESOLVED BY TI-IE CQJv1MISSION OF THE CITY OF BOZEMAN: See tion 1 That there be, and there is hereby created a sppcial improvement district of the City of Bozeman to be known and designated as Special Improvement Lighting District No. 491 for the purpose of installing and maintaining a lighting system to light Hain Street between the Centerline of Buttom.;rood Avenue and Highway Station 21+50.8 being the end of Main Street highway construction and beginning of Interstate 90, said lighting system to be installed and paid for by the State High\.;ray Commission of the State of Montana, all under the authority of and in conformity \.;rith Sections 11-2245 to 11-2257, inclusive, of the Revised Codes of Hontana, 1947, pursuant to and in conformity with Commission Resolution No. 1396 of the Commission of the City or Bozeman, passed and adopted on the 18th day of December, 1968, \.;rhich said Cotmllission Resolution No. 1396 declares I it to be the intention of said City Commission to create a said Special Improvement Lighting Dis- tric t No. !191 for the purpose aforesaid, and which said Commission Resolution No. 1396 is of reeoro and on file in the office of the Clerk of said Ci ty Commission in the Ci ty Hall 'Building, Bozeman, and is open to the inspection of the public, and is hereby referred to further particulars. Section 2 That said Commission Resolution No. 1396 is hereby referred to and made a part hereof for f11rther particulars in respect to the boundaries of said Special Improvement District No. 491, COMMISSION RESOLUTION NO. 1398 -- --".. .....-. - -....- --- ........-- .--.-....,.,.. ...- 35 the estimated cost of said improvements and the method of assessing the same against the property of said District. .. ", Section 3 . The Character of improvements to be installed and paid for by the S ta te High1vay CO"lmis sian of the Sta tc of Man tan a is the erection and installation of ten (10) 1,000 Watt (51+,000 Lumen) I Mercury-Vapor color corrected luminaires mounted on Aluminum Alloy 6063-T6 poles with 12 foot bracl{e ts (mountinr, height of luminaire bo be (.5 feet). Power for the Ten (10) 1,000 Hatt (5/+,000 1 umen) luminaires is to be supplied thru underground conduits and the installations shall be equipped with all necessary appliances for safe and proper operation of the system. Section Lf The proposed Special Improvement Lighting District will be established for the purpose of paying the operating and maintenance cost of such lights only, which said operation and maintenance 1\,"'i 11 include the furnishing of electric current, all lamps as needed and the maintenance of poles, cables and other incidental items. The entire installation cost of such li8hts will be borne by the State Highway Commission of the State of Montana, The portion of the cost of maintenance and electrical current payable by the City of Bozeman will be paid directly by the City of Bozeman and the portion to be assessed against the property within the district will be assessed and paid annually as provided by law.
