HomeMy WebLinkAboutSILD 460, Resolution 1242 (Main to Oak) 1:10 COMMISSION RESOLUTION NO. 1242 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPRO\~MENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 460 OF THE CITY OF BO ZEMAN FOR lliE PURPOSE OF OPERATING AND MAINTAINING A STREET LIGHTING SYSTEM TO LIGHT NORTH SEVENTH AVENUE BETWEEN A POINT 140 FEET NORTH OF MAIN STREET TO THE PRESENT CITY LIMITS AT 'IRE NORTHERLY LINE OF OAK STREET AND THE ADJACENT STREETS EAST AND WEST OF I SAID NORTH SEVENTH AVENUE FOR A DISTANCE OF 115 FEET EITHER SIDE OF SAID SEVENTH AVENUE. WHEREAS, at a regular session of the Commission of the City of Bozeman, Sta te of Montana, held on the Is t day of Sep tember, 1965, the said Commission duly passed Commission Resolution No. 1237 declaring it to be the in ten tion of the said Commission to create a special improvement district to be known and designated as ~pecial Improvement District No. 460 of the said City for the pur- pose of operating and maintaining a street lighting system to light North Seventh Avenue between a point 140 feet Nor th of Main Street to the present ci ty 1imi ts at the northerly line of Oak Street and the adjacent streets East and West of said North Seventh Avenue for a distance of 115 feet either side of said Seventh Avenue said lighting system to be installed and paid for by the Montana Power Company, all under the authority of ardin conformity with Sections 11-2245 and 11-2257, in- clusive, of the Revised Codes of Montana, 1947, which said Resolution of Intention is of record and on file in the office of the Clerk of said City Commission and open to the inspection of the public, and is hereby referred to for further parti- culars; and I WHEREAS, due proof has been made that service of notice of the adoption of said Resolution No. 1237 was duly made and given as by law provided; and WHEREAS, at the time and place fixed in said Resolution No. 1237 for the making and filing of protests against the creation of said proposed Special Improve- ment Light District No. 460, to-wit, at the hour of 1:00 o'clock p.m. on Wednesday the 29th day of September, 1965, being a regular meeting time of said City Commiss- ion, at the Commission Chamber in the City Hall Building of the City of Bozeman, there were not sufficient protests made or filed against the creation of said Special Improvement Lighting District No. 460. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: SECTION 1 That there be, and there is hereby created a special improvement district of the City of Bozeman to be known and designated as Special Improvement Lighting District No. 460, for the purpose of installing and maintaining a lighting system to light North Seventh Avenue between a point 140 feet North of Main Street to the present Ci ty limi ts at the northerly line of Oak Street and the adjacent streets I east and west of said North Seventh Avenue for d distance of 115 feet either side of said Seventh Avenue, said lighting system to be installed and paid for by the Montana Power Company, all under the au.thority of and in conformity with Sections 11-2245 to 11-2257 inclusive, of the Revised Codes of Montana, 1947, pursuant to' and in conformity with Commission Resolution No. 1237 of the Commission of the City of Bozeman, passed and ado p ted on t he Is t da y of September, 1965, which said Comm- Commission Resolution No. 1242 -....- 111 ission Resolution No. 1237 declares it to be the Intenti~n of said City Commission to create said Special Improvement Lighting District No. 460 for the purposes afore- said, and which said Commission Resolu tion No. 1237 is of record and on file in the office of the Clerk of said City Commission in the City Hall Building, Bozeman, and I is open to the inspection of the public, and is hereby referred to for further particulars. SECTION 2 That said Commission Resolution No. 1237 is hereby referred to and made a part hereof for further particulars in respect to the boundaries of said Special Improvement District No. 460, the estimated cost of said improvements and the method of assessing the same against the property of said ~istrlct. SECTION 3 The character of the improvement to be ins taIled and paid for by the Montana Power Company is the erection and installation of thirty-three (33), 400 Watt, 20,000 lumen Mercury Vapor, color corrected luminaires, mounted on 30 feet high steel poles and eighteen (18), 175 Watt, '7000 lumen Mercury Vapor, color corrected luminaires mounted on 30 feet high steel poles. Power is to be fed by a single overhead wire and the installation shall be equipped with all necessary appliances for the safe and proper opera tion of the system. SECTION 4 I The proposed Special Improve~ent Lighting District will be established for the purpose of paying the operating and maintenance cost of such lights only, which said operation and maintenance will include the furnishing of electric current, all lamps as needed and the maintenance of poles, cables, and other incidental items. The entire installation cost of such lights will be borne be the MOntana Power Company The portion of the cost of maintenance and electrical current payable by the City of Bozeman will be paid directly by the City of Bozeman and the portion to be assessed against the property within the district will be assessed and paid annually as pro- vided by law.
