HomeMy WebLinkAbout15- Property Owner Letter for Creation of Arterial and Collector Street Special District Assessment June 26, 2015 RE: Notice of passage of resolution of intent to create the Arterial and Collector Streets Special District, notice of right to protest, and notice of public hearing on August 31, 2015; Tree Maintenance Assessment Notice Arterial and Collector Streets Special District The City of Bozeman is developing a long range plan to improve the transportation system within our community. Many of our major roadways (designated as arterial and collector streets) are incomplete resulting in traffic congestion and safety issues for motor vehicles, cyclists and pedestrians. Improving transportation throughout the City requires the City to finish partially completed roadways, install traffic roundabouts and signals and complete pedestrian and bicycle facilities. At a public hearing on June 22, 2015, the Bozeman City Commission adopted Resolution 4603, a resolution of intent to create the Arterial and Collector Streets Special District (the “District”). On the back of this letter you will find a copy of the notice of passage of Resolution 4603. According to Resolution 4603, the District, if created, will comprise the entire incorporated limits of the City of Bozeman and will be for the purpose of constructing, improving and maintaining portions of the city’s transportation network classified as arterial and collector streets. A complete copy of Resolution 4603 is on file with the Bozeman City Clerk which more specifically describes the proposed District. If created, the costs of the District will be assessed annually to all owners of real property within the District based upon the assessable area of each lot or parcel, expressed in square feet, subject to the maximum square footage caps listed in Resolution 4603. This is the same method of assessment as is used for the City’s Street Maintenance District. A typical residential parcel is estimated to be assessed $21.54 for Fiscal Year 2016. Owners of property liable to be assessed for the improvements in the proposed District have 60 days – from June 26, 2015 to August 25, 2015 – to make a written protest against the creation of the District and its improvements. If a written protest is not delivered to the City Clerk by the end of the protest period, the owner’s lack of action must be construed by the Commission as support of the creation of the District. A protest form with instructions is included. If you own multiple properties within the City you will be sent only this one Notice. Please return a separate protest form for each property you own. The Commission will conduct a public hearing on Monday, August 31, 2015 at 6:00 pm in the Commission room at Bozeman City Hall, 121 North Rouse Ave., Bozeman to consider a resolution to create the District. During this public hearing the City Commission will accept public comment and consider all validated written protests submitted prior to the established deadline of midnight on Tuesday, August 25, 2015. This Notice is the same as you received in previous years and is unrelated to the proposed Arterial and Collector Streets Special District. It is included in this mailing to save costs. Sincerely, Stacy Ulmen, Bozeman City Clerk NOTICE OF PASSAGE OF RESOLUTION OF INTENTION TO CREATE THE ARTERIAL AND COLLECTOR STREET SPECIAL DISTRICT, CITY OF BOZEMAN, MONTANA AND NOTICE OF HEARING NOTICE IS HEREBY GIVEN that on June 22, 2015, the City Commission (the “Commission”) of the City of Bozeman, Montana (the “City”), adopted Resolution 4603, a Resolution of Intention to Create the Arterial and Collector Street Special District (the “District”) for the purpose of constructing, improving, and maintaining transportation facilities on arterial and collector roadways (the “Improvements”) and assessing the costs therefore to benefitted property by the annual levy of a special assessment. A complete copy of the Resolution of Intention to Create the Arterial and Collector Street Special District (the “Resolution”) is on file with the City Clerk which more specifically describes the nature of the Improvements, the boundaries and the area included in the District, the location of the Improvements and other matters pertaining thereto. All properties in the District, comprised of the entire incorporated city, as amended from time to time by annexation, will be assessed for their proportionate share of the costs of the Improvements which will be payable in equal semiannual installments. The total annual costs of the Improvements in the first year are estimated to total $576,000, and shall be assessed against each lot or parcel of land based upon total square footage. The total area of the District to be assessed is estimated to be 200,521,000 square feet. The initial cost of the Improvements is estimated to be $0.00287 per square foot. A typical residential parcel is estimated to be assessed $21.54 for the year. A list of properties subject to potential assessment, fees or taxation under the creation of the proposed special district is available for public inspection in the City Clerk’s office, 121 N. Rouse Avenue, Bozeman, Montana during normal business hours. The list may not be distributed or sold for use as a mailing list in accordance with Section 2-6-109, MCA. On Monday, August 31, 2015, at 6:00 p.m., in the Commission Room of City Hall, 121 N. Rouse Avenue, Bozeman, Montana, the City Commission will conduct a public hearing and pass upon all written protests against the creation of the District and its Improvements. Written protests against the creation of the District and its Improvements may be filed by a person or other entity owning real property within the proposed District whose property is liable to be assessed for the Improvements. Such protests must be delivered to the City Clerk at City Hall, 121 N. Rouse Avenue, Bozeman, Montana, not later than midnight on Tuesday, August 25, 2015. A copy of this Notice and a Protest form, with instructions for completing and returning the form, will be mailed to each owner or purchaser under contract for deed of the properties included on the list of properties subject to potential assessment. Protest forms may also be picked up at the Office of the City Clerk, 121 N. Rouse Avenue Suite 202, Bozeman, Montana during normal business hours.
