Resolution 4604, Intoximeters Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Rich McLane, Deputy Chief of Police SUBJECT: Resolution 4604 – Donation of City equipment to other government agency. MEETING DATE: June 8, 2015 AGENDA ITEM TYPE: Consent RECOMMENDATION: Pass and Approve Resolution 4604 allowing three Intoximeters to be donated to Gallatin County Drug and Alcohol Services. BACKGROUND: The Police Department has recently purchased new Intoximeters to gather breath samples to determine blood alcohol content of persons as part of DUI investigations or other investigations regarding where alcohol presence or levels in a person need to be determined. Older units are of little to no value for police operations. Gallatin County Drug and Alcohol Services have asked for three Intoximeters for their uses. This donation would be an appropriate and acceptable partnership to address alcohol abuse. UNRESOLVED ISSUES: None. ALTERNATIVES: As recommended by the commission. FISCAL EFFECTS: None. Attachments: Resolution 4604 Report compiled on: May 22, 2015 136 COMMISSION RESOLUTION NO. 4604 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AUTHORIZING THE DONATION OF CERTAIN ITEMS FROM THE CITY OF BOZEMAN POLICE DEPARTMENT TO OTHER GOVERNMENT AGENCIES WITHIN THE STATE OF MONTANA. WHEREAS, the City of Bozeman Police Department has recently purchased new intoximeters used to verify the levels of alcohol on the breath of persons; and WHEREAS, the intoximeters replace older, less reliable intoximeters that have minimal value and are no longer needed; and WHEREAS, the Gallatin County Drug and Alcohol Services has a need for three intoximeters; and WHEREAS, Article 6, Div. 5, Bozeman Municipal Code, grants the City of Bozeman the power to donate property which is no longer necessary for the conduct of City business; and NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana; Section 1 The City Commission hereby determines the three Intoximeters to be replaced are no longer necessary for the conduct of City business and it is in the best interest of the City to donate the three Intoximeters to Gallatin County Drug and Alcohol Services.
