Funding for Construction Pond Row Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Carolyn Poissant – Manager of Trails, Open Space, and Park Development Mitch Overton – Director of Parks and Recreation SUBJECT: Approval of Funding for Pond Row Road and Related Infrastructure Improvements MEETING DATE: June 8, 2015 AGENDA ITEM TYPE: Action RECOMMENDATION: Approve the allocation of funding for the construction of Pond Row road and associated infrastructure improvements in the amount of up to $580,000 from the Trails Open Space and Parks (TOP) Bond fund. RECOMMENDED MOTION: I hereby move to approve the allocation of funding for the construction of Pond Row road and associated infrastructure improvements in the amount of up to $580,000 from the Trails Open Space and Parks (TOP) Bond fund. BACKGROUND: At the Commission meeting of December 2, 2013, there was discussion concerning the completion of Pond Row road and infrastructure improvements. As delineated in Director Overton’s memo (excerpted below), it was recommended that the Pond Row road and related infrastructure be constructed in Phase II, i.e., during park construction. At that time, the cost was estimated to be about $250,000. Pond Row/Ravalli Street: Concurrent with development of Phase II of the Project we recommend Ravalli Street/Pond Row be completed to a local street standard. At this time, the application does not include funding for construction of Ravalli Street/Pond Row through the Project. Pond Row runs south from Babcock along the northeast edge of the Project ending along the north edge of HAVEN’s proposed community center. Ravalli Street will, if constructed, run east/west through the Project and is planned to connect to Pond Row in front of the proposed location of HAVEN’s community center. Should the City construct a parking lot on the south side of Ravalli Street, Ravalli Street must be completed at a minimum from Fowler to the eastern edge of the entrance to the new parking lot. Construction of the entire road through the Project is estimated to cost approximately $250,000. Options for funding Ravalli Street/Pond Row include using the TOP Bond for the City’s proportionate share of the entire road (with HAVEN contributing its proportionate share through direct contribution) or the City’s general fund. As noted above, we recommend Ravalli/Pond Row be constructed concurrent with development of Phase II of the Project. Access to the amenities included in Phase II should be provided by a City 304 standard street to ensure access for people with disabilities, or others unable to access these amenities through the use of an un-paved trail. In addition, constructing Ravalli/Pond Row is called for through the City’s transportation plan. The extent of construction and the timing, however, will depend on a determination of funding for the City’s proportionate share, the timing for construction of a parking facility, and the timing of development of HAVEN’s community center. Regardless of the specific timing of the above elements, we believe complete construction of Ravalli/Pond Row should occur concurrently with Phase II. It was decided not to allocate funding for Pond Row at that time, but to do so when more detailed cost estimate information became available. Pond Row is local street connector that provides better connectivity for the area as well as on- street parking for the park. An engineer’s estimate of probable costs for the construction of Pond Row was completed and reviewed by Public Works (Attachment A). This estimate includes all road and associated infrastructure improvements, including sidewalks, boulevard trees, and irrigation. Note: The only other property financially affected by construction Pond Row is the HAVEN site to the east of the park on the south side of the road. HAVEN’s share of Pond Row infrastructure is approximately 20% (based on linear street frontage) or $116,000. The TOP Bond balance of $1,343,000 includes $428,000 in premium and interest earnings in addition to the $915,000 unallocated balance form the initial $15 million. It is recommended that additional funding in the amount of $580,000 be allocated to the Bozeman Pond Expansion TOP project to cover the additional costs of design, construction, and project management of Pond Row road and infrastructure improvements as these improvements will directly benefit the park. City engineering, community development, and parks department staff will continue to hold project status meetings to ensure that road and infrastructure design and construction in the rights- of-way surrounding the park, as well as improvements on adjacent properties being developed, are well coordinated. UNRESOLVED ISSUES: A payback district will need to be formed for Pond Row construction. NEXT STEPS: Approve a resolution to amend the description of improvements to be included in the Bozeman Pond Expansion project to conform to the Master Plan and authorize use of TOP Bond funding for the construction of Pond Row. ALTERNATIVES: Funding source alternatives include the following: 1) unallocated balance of the TOP bond fund; 2) General Fund (requiring a budget adjustment); 3) Cash-in-lieu of parkland dedication fund; 4) Other source(s) per Commission direction. FISCAL EFFECTS: The Agreement will allow the project to proceed and be in conformance with all City land use development code requirements.
