SUGGESTED MOTION: I hereby move to approve the Bozeman Pond Park Expansion Master Plan as presented by staff. BACKGROUND: Resolution No. 4494 approved the allocation of Trails, Open Space and Parks (TOP) bond funding in an amount not to exceed $1,045,000 for the acquisition of park land and development of the Bozeman Pond Park Expansion Project (“Project”). Resolution 4494 states the primary goals of the Project are to include: 1) a 5-acre natural park between the existing Bozeman Pond Park and Ravalli Road; 2) a 3.5 –acre off-leash dog exercise area; 3) a paved, shared-use path paralleling Fowler and natural surface trails that offer recreational opportunities, provide access to park amenities, and create alternative transportation routes to community facilities; and 4) a restroom and 5) a 50-car parking lot to serve the park, dog area, and nearby Aasheim Ball Fields (adjacent to Hyalite Elementary school). A conceptual plan (Attachment A) was provided as part of the application, which was further refined during the public input process to develop a master plan including all of the items specified in the resolution (Attachment B). Several community members spoke in support of the project at the Commission meeting of December 2, 2013. The land purchase was completed in 2014 for $607,100 leaving $437,900 for construction of park improvements. The public input process for the park included an online survey and two public meetings during which a conceptual master plan prepared by Dr. Dick Pohl was reviewed and discussed. In order to produce a detailed Master Plan, a site plan for DRC review, plus construction documents and to provide for construction management services, a design and engineering consultant contract in the amount of $83,240 was approved on February 9, 2015, leaving a balance of $354,491 for park construction. The Master Plan for the park includes all of the features shown on the conceptual plan, with the parking lot indicated as a future phase:  Three 12 x 20 picnic shelters with 2 tables each 297  2-acre fenced off-leash dog park  Outdoor classroom with natural play area  Two-stall pre-fabricated restroom (similar model as installed at Lindley Park)  10-ft wide paved, multi-use path along Fowler (connecting to the existing near Huffine)  Gravel fines accessible trails connecting park features  2 park benches, waste receptacles, and park entry sign  All code-required landscaping and irrigation, with some additional trees and shrubs The Recreation and Parks Advisory Board approved the proposed Bozeman Pond Park Expansion Master Plan on April 9, 2015. Their motion included the following recommendations: 1) Complete a first phase of Pond Row road and infrastructure improvements until HAVEN is ready to build by paving from the park entry at Ravalli to the east end of the parking lot; 2) Install a gravel parking lot without curbing; and 3) Provide an easement for the Hearts and Homes well and backyard fence. However, to fully comply with city policy and code requirements, Pond Row would need to be constructed in its entirety and the parking lot would need to be curbed and paved. It is also necessary to install parking lot landscaping and watercourse setback landscaping to meet code requirements. As such, under the current project budget, we cannot afford to build the parking lot. A slightly revised master plan was prepared for Commission approval (Attachment B) that postpones construction of the parking lot to a future phase when funding becomes available. There is room for approximately 35 parking spaces along the Pond Row street frontage of the park, which will include a minimum of two signed, barrier-free parking spaces near the park entry. An undeveloped turf area will be available for the future construction of a 20-space parking lot. The total estimated cost of the park improvements, without any Pond Row improvements except crosswalks and signage, and without the parking lot, is $354,158 (see Attachment C). Construction of Pond Row road and infrastructure improvements requires additional funding in the amount of $580,000 (discussed in a separate Action Item which follows on tonight’s agenda). A variance for the construction of Fowler Road improvements will be required. The Public Works Department supports the variance as additional right-of-way needs to be secured before the full segment of Fowler Road from Huffine to Babcock can be constructed. The proposed paved, muti-use path and park improvements are located outside of the existing 100-foot Fowler right-of-way. Once the Master Plan is approved, the site plan will go through DRC review for final approval. The estimated construction schedule is August – September 2015 with additional work by partners and volunteers (for the dog park, trails, and playground) occurring in early October. The project is expected to be completed by November 1, 2015. City engineering, community development, and parks department staff will continue to hold project status meetings to ensure that road and infrastructure design and construction in the rights- of-way surrounding the park, as well as improvements on adjacent properties being developed, are well coordinated. UNRESOLVED ISSUES: An easement for access to an existing well needs to be granted to the property owner to the north (Help Center, Inc.). We are also working with the Help Center to create an easement to allow extension of the paved trail along the west edge of the dog park with a possible mid-block crossing to the Aasheim ballfields, in exchange for allowing the backyard fence and play equipment to remain in an easement on park property. 298 ALTERNATIVES: Per Commission.
