Hereafter, no person within the corporate limits of the Ci ty of 'Bozeman, Montana, shall be allo\ved to construct or use a cess pool or privy vault if there is a City sewer in the drainage district in which the property containing the same is located; and further, when a City sewer passes the property of any person or persons who are now using cess pools or privy vaults, said person or persons shall be required to make connections with said sewer not later than one year from the completio~ and acceptance by the City of said sewer, ~xcept in case of such cess pools or privy vaults as may at any time be declare,d by the Council to be a nuisance, in which case the owner or owners 0::' any property upon which such cess pool or privy vault is located ehall be required to make connections with sh~d sewer at once. Section 2. , , If any property bordering- on any streetl or avenue in which there is a City sewer shall, by reason o~ not being connected with said City sewer, become dan~erous to public health, the City Council may declare the same a public nuisance and may order the owner thereof to connect with the City sewer. Section 3. Section 4 and Section 9 of Ordinance No. 300 of the City of Bozeman entitled, "An Ordinance regulating and governing plumbing and the , use of sewers in the City of Bozeman; and the providing for the appointment of a plumbing Inspector and defining his duties; and a Board of Examiners and providing a penalty; and repealing Ordinance lJo. 227, entitled "An Ordinance Regulating the use of sewers and drains and the plumbing and drain laying ",:iI,::: .< 1 "'i\ 1 1 1 , .,. I' -479- I in connection therewith, and providing for the appointment of a Sewer Commissioner and defining his duties", and all other Ordinances and parts of Ordinances, in conflict herewitt, are hereby repealed. Section 4. Any owner or occupant of any property within the City of I , ( Bozeman or any other person or persons failing, neglecting or refusing to Domply with any of,the conditions, regulations and requirements of this Ordinance shall be guilty of- a mlsdemean9r , and upo:p. conviction thereof shall be fined in a sum not less than Ten ($lO.OO) Dollars, and not more I than One Hundreda($lOO.OO) Dollars for each offense. .And each day t s failure, neglect or refusal to comply with the provisions of this Ordinance shall be deemed a separate and distinct offense and su~ject to like fine. The Mayor shall, at the time of apPOinting other city officers, appoint an Inspector of Buildings, whose term of office shall be two years, or until his successor is appointed and qualified; but, if at any time such Inspector proves to be incompetent, dishonest or in any way unsuited to the o~fice, he may be removed by the Mayor or City Council, and upon such removal the Mayor shall appoint an Inspector to fill the unexpired I term. Such Inspector shall be a practical builder or arc:Li teet, who has been engaged in the active duties of his occupation for at least ten years. Section 2. $25.00 per month. The.lnspector of Buildings shall receive a :::;alary of Section 3. He shall, before he enters upon the duties of his office, take and subscribe an oath before the City Clerk, to faithfully and im- partially execute the duties of his office, and shall give a bond in the Bum of One ':'housand Dollars, with two or more sufficient sureties, to be apnroved by the City Council, conditioned for the faithful performance of I his duties. He shall keep an office at the City Hall, or at such other place as shall,be furnished at the expense of the City. Section 4. It shall be the duty of said Inspector to keep a-record of all permits issued, whieh shall be regularly numbered in the order of their i s s ue . Also, a record, showing the number, description and size of every buildin~ erected in the city durin~ his term of office; of what material construdted, the aggregate of the number, kind and cost of all buildings, and the sanitary condition of all buildin~s. It shall be the duty of said Inspector, upon bein~ served with a notice requiring him to vi si t, and inspect a building, upon, or in whiCh" work is being done, under f1.ny of the provisions of this Ordinance, to do so., I
