PUBLIC STREET & UTILITY EASEMENT
The Fulmont, LLC, P.O. Box 3926, Bozeman, MT 59772-3926,
GRANTOR, in consideration of $1.00 and other good and valuable
considerations, receipt of which is acknowledged, grants to The City of
Bozeman, a municipal "corporation of the State of Montana, with offices at
411 East Main Street, Bozeman, Montana 59715, GRANTEE, its
successors and assigns, a perpetual street and utility easement for the
use of the public, in, through, and across a parcel of land situated in
Gallatin County, Montana, to be located on the following described real
property:
A public street & utility easement across Lot 1, Block 1, Amended
Subdivision Plat Rearrangement of Block 1, Bridger Center
Subdivision, as filed with the Gallatin County Clerk and Recorder,
located in the southeast quarter of Section 31, Township 1 South,
Range 6 East, P.M.M., City of Bozeman, Gallatin County, Montana,
as shown on Exhibit 'A', and being more particularly described as
follows:
A circular easement being circumscribed by a 50.00 foot radius arc
centered on the following described point:
Commencing at the southwest corner of said Lot 1, thence along.
the western terminus of Commercial Drive right-of-way as platted in
the Bridger Center Subdivision, South 2r47'20" East a distance of
33.70 feet, to the centerline of Commercial Drive, the True Point of
Beginning;
Thence easterly along said Commercial Drive centerline
North 89015'00" East a distance of 22.48 feet to the radius point of
the easement.

The easement being all that part of said Lot 1 within a 50.00 foot
radius arc with a central angle of 103048'48", and an arc length of
90.59'.
The length of the arc being adjusted, as required, so as to begin on
the north line of said Lot 1, and end on the west line of said Lot 1.

Said easement contains 0.026 acres, more or less.
The GRANTOR states that he possesses the real property described above and
that he has a lawful right to grant an easement thereon.

The GRANTOR further agrees that the GRANTEE may peaceably hold and
enjoy the rights and privileges herein granted without any interruption by the
GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be
binding upon the heirs, executors, administrators, personal representatives, successors,
and assigns of the parties hereto.
