DETENTION POND EASEMENT F. Delbrook Lichtenberg and Roberta Moche, 1502 Gold Avenue, Bozeman, Montana 59715-2471 and
4353 Pahoa Avenue, Honolulu, Hawaii 96816, respectively, GRANTORS, in consideration of One Dollar
($1.00) and other good and valuable consideration, receipt of which is acknowledged, grant to the City of
Bozeman, a municipal corporation ofthe State of Montana, with offices at 411 East Main, P.O. Box 1230,
Bozeman, Montana 59771-1230, GRANTEE, its successors and assigns, an easement for public storm
drainage detention pond purposes, in, through and across the following described real property situated in
Gallatin County, Montana, more particularly described as follows:
A public storm drainage detention pond easement across Certificate of Survey 885, as
filed with the Gallatin County Clerk and Recorder, located in the southeast quarter of
Section 31, Township 1 South, Range 6 East, P.M.M., Gallatin County, Montana, as
shown on Exhibit' A', and being more particularly described as follows:
An easement being a 65.00-foot wide strip of land lying east of the following described
line:
Commencing at the Southwest comer of the Northwest One-quarter of the Southeast
One-quarter of said Section 31, thence along the west line of said Certificate of Survey
885, North 02003' 19" West a distance of 15.00 feet, to the True Point of Beginning;
Thence continuing along said west line North 02003'19" West a distance of 110.00 feet,
to the end of said easement.
Said easement contains 0.16 acres, more or less.
The GRANTORS warrant that they are lawfully seized and possessed of the real property described
above, that they have lawful right to convey the property, or any part of it, and that they will forever
defend the title of the property against the claims of all persons. The GRANTORS further agree that the
GRANTEE may peaceably hold and enjoy the rights and privileges herein granted without any
interruption by the GRANTORS.
