DRAINAGE EASEMENT . ,.......,.~ ' ..,',
/' F. Delbrook Lichtenberg and Roberta Moche, 1502 Gold Avenue, Bozeman, Montana 59715-2471 and
4353 Pahoa Avenue, Honolulu, Hawaii 96816, respectively, GRANTORS, in consideration of One Dollar
($1.00) and other good and valuable consideration, receipt of which is acknowledged, grant to the City of
Bozeman, a municipal corporation of the State of Montana, with offices at 411 East Main, P.O. Box 1230,
Bozeman, Montana 59771-1230, GRANTEE, its successors and assigns, an easement for public storm
drainage purposes, in, through and across the following described real property situated in Gallatin
County, Montana, more particularly described as follows:
A public storm drainage easement across Certificate of Survey 885, as filed with the
Gallatin County Clerk and Recorder, located in the southeast quarter of Section 31,
Township 1 South, Range 6 East, P.M.M., Gallatin County, Montana, as shown on
Exhibit' A', and being more particularly described as follows:
An easement being a 15.00-foot wide strip ofland lying north of the following described
line:
Connnencing at the Southwest comer of the Northwest One-quarter of the Southeast
One-quarter of said Section 31, the True Point of Beginning;
Thence along the south line of said Certificate of Survey 885, being the South line of the
Northwest One-quarter of the Southeast One-quarter of said Section 31,
North 8r55'08" East a distance of 160.31 feet, to the northeast comer of Tract A of
Certificate of Survey 27a, as filed with the Gallatin County Clerk and Recorder, and the
end of said easement.
Said easement contains 0.06 acres, more or less.
The GRANTORS warrant that they ate lawfully seized and possessed of the real property described
above, that they have lawful right to convey the property, or any part of it, and that they will forever
defend the title of the property against the claims of all persons. The GRANTORS further agree that the
GRANTEE may peaceably hold and enjoy the rights and privileges herein granted without any
interruption by the GRANTORS.

The terms, covenants and provisions of the easement and agreement shall extend to and be binding upon
the heirs, executors, administrators, personal representatives, successors and assigns of the parties hereto.
