PUBLIC STREET & UTILITY EASEMENT
Jay Fulwiler, P.O. Box 3926, Bozeman, MT 59772-3926, GRANTOR,in
consideration of $1.00 and other good and valuable considerations,
receipt of which is acknowledged, grants to The City of Bozeman, a
municipal corporation Df the State of Montana, with offices at 411 East
Main Street, Bozeman, Montana 59715, GRANTEE, its successors and
assigns, a perpetual street and utility easement for the use of the public,
in, through, and across a parcel of land situated in Gallatin County,
Montana, to be located on the following described real property:
A public street & utility easement across Tract A of Certificate of
- Survey 27a, as filed with the Gallatin County Clerk and Recorder,
located in the southeast quarter of Section 31, Township 1 South,
Range 6 East, P.M.M., City of Bozeman, Gallatin County, Montana,
as shown on Exhibit 'A', and being more particularly described as
follows:
A circular easement being circumscribed by a 50.00 foot radius arc
centered on the following described point:
Commencing at the northeast corner of said Tract A, thence along
the northeast line of said Tract A, South 2r47'20" East a distance
of 238.24 feet, to the point where said northeast line of said Tract A
intersects the centerline of Commercial Drive, as platted by the
Bridger Center Subdivision, the True Point of Beginning;
Thence easterly along said Commercial Drive centerline
North 89015'00" East a distance of 22.48 feet to the center of the
easement;
The easement being all that part of said Tract A within an arc with a
central angle of 132050'37", and an arc length of 115.93'.

The length of the arc being adjusted, as required, so as to begin
and end on said northeast line of Tract A. Said easement contains
0.045 acres, more or less.
The GRANTOR states that he possesses the real property described above and
/
that he has a lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and
enjoy the rights and privileges herein granted without any Interruption by the
GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be
binding upon the heirs, executors, administrators, personal representatives, successors,
and assigns of the parties hereto.
