Box 3926, Bozeman, MT 59772-3926, GRANTOR, in consideration of One Dollar ($1.00) and other good and valuable consideration, receipt of which is acknowledged, grants to the City of Bozeman, a municipal corporation of the State of Montana, with offices at 411 East Main, P.O. Box 1230, Bozeman, Montana 59771- 1230, GRANTEE, its successors and assigns, an easement for public storm drainage purposes, in, through and across the following described real property situated in Gallatin County, Montana, more particularly described as follows: A public storm drainage easement across Tract A of Certificate of Survey 27a, as filed with the Gallatin County Clerk and Recorder, located in the southeast quarter of Section 31, Township 1 South, Range 6 East, P.M.M., City of Bozeman, Gallatin County, Montana, as shown on Exhibit 'A', and being more particularly described as follows: An easement being a 15.00 foot wide strip of land lying south of the following described line: Commencing at the Southwest corner of the Northwest One-quarter of the Southeast One-quarter of said Section 31, being the northwest corner of said Tract A, the True Point of Beginning; Thence along the north line of said Tract A, North ar26'50" East a distance of 160.31 feet, to the northeast corner of said Tract A. Also, an easement being a 30.00 foot wide strip of land lying southwesterly of the following described line: Thence continuing from said northeast corner, along the northeast line of said Tract A, South 2r42'20" East a distance of 271.94 feet, to the south Page 1 of 4 . . The length of the easement sidelines being adjusted, as required, so as to end on the projected south right-of-way line of said Commercial Drive. Said easement contains 0.23 acres, more or less. The GRANTOR warrants that he is lawfully seized and possessed of the real property described above, that he has lawful right to convey the property, or any part of it, and that he will forever defend the title of the property against the claims of all persons. The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted without any interruption by the GRANTOR. GRANTEE hereby acknowledges and agrees that GRANTOR may use said easement, and the adjoining Drainage and Detention Pond Easements on Certificate of Survey 885 for storm drainage purposes upon development of said Tract A, Certificate of Survey 27a. The terms, covenants and provisions of the easement and agreement shall extend to and be binding upon the heirs, executors, administrators, personal representatives, successors and assigns of the parties hereto.
