RR Construction Agreement186 1 Legal Office Remodel CONSTRUCTION AGREEMENT This Construction Agreement is made this 1st day of June, 2015 by and between the CITY OF BOZEMAN, MONTANA, a municipal corporation organized and existing under the laws of the State of Montana, P.O. Box 1230, Bozeman, Montana 59771-1230 (“City”), and R & R Taylor Construction Inc., a Corporation, of 1775 Love Lane, Bozeman, Montana 59715, (“Contractor”). Recitals A. The City issued a Request for Bid for the construction project known as Legal Office Remodel at City Hall Project (the “Construction Project”) pursuant to the requirements of all applicable statutes, rules, regulations, and ordinances. B. The City analyzed all responses to the Request For Bid received pursuant to its standard practices and the requirements of all applicable statutes, rules, regulations, and ordinances. C. The City awarded the bid to Contractor on June 1, 2015, pursuant to the terms and conditions of this Agreement. NOW THEREFORE, in consideration of the covenants, agreements, representations, and warranties contained herein, the parties agree as follows: Agreement 1. Work to be Performed: a. A description of the Construction Project and Contractor’s duties is set forth in the Request For Bid and Bid Form as awarded and accepted by City and the Project Manual for the Legal Office Remodel Project, which are attached hereto and incorporated herein by this reference, and the drawings, plans, and specifications provided by the City and its architects and engineers. The City’s Award is attached here as Exhibit A. Where a provision of the Project Manual conflicts with this Agreement the terms and conditions of this shall Agreement control. b. Prior to the commencement of any work on the Construction Project, Contractor’s representatives and City’s representatives shall hold a meeting to establish a working understanding among the parties as to the scope of the Construction Project and duties of the Contractor. At this meeting, Contractor and City shall resolve any outstanding issues related to the plans, designs, drawings, and specifications.
