PUBLIC STREET AND UTILITY EASEMENT
North 27th Avenue
JERALD E. SWENSON, of 6071 Jackrabbit Lane, Belgrade, Montana 59714, GRANTOR, in
consideration of $ 1.00 and for other and valuable considerations, receipt of which is
acknowledged, grants to The City of Bozeman, a municipal corporation of the State of Montana,
with offices at 411 East Main, Bozeman, Montana 59771-0640, GRANTEE, its successors and
assigns, a perpetual street and utility easement for the use of the public, in, through, and across
land situated in Gallatin County, Montana, ninety (90.00) feet wide for North 2ih Avenue to be
located on the following described real property:
The easement is located across Lot 1 of Minor Subdivision No. 221, as filed with the
Gallatin County Clerk and Recorder, more particularly described and depicted on the attached
Exhibits A and B which by this reference are made a part hereof.
The GRANTOR states that they possess the real property described above and that they
have a lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding
upon the heirs, executors, administrators, personal representatives, successors, and assigns of the
parties hereto.

Legal Description
North 2ih Avenue
A 90 foot wide public street and utility easement across Lot 1, Minor Subdivision No. 221, as
filed with the Gallatin County Clerk and Recorder, located in the southwest quarter of Section
26, Township 1 South, Range 5 East, P.M.M., Gallatin County, Montana, as shown on Exhibit B,
and being more particularly described as follows:
Commencing at the south quarter comer of said Section 26;
Thence along the north-south mid-section line of said Section 26, North 00048'34" East a
distance of 1061.82 feet, to the south line of said Lot 1 extended;
Thence leaving said north-south mid-section line and running along said south line, South
89044'31" West a distance of392.57 feet, to the southeast corner of the easement being
described and the True Point of Beginning;
Thence continuing along said south line, South 89044'31" West a distance of 90.02 feet;
Thence leaving said south line, North 00048'34" East a distance of 486.64 feet, to the beginning
of a curve to the right;
Thence northerly along said curve having a radius point bearing South 89011 '26" East a distance
of 450.00 feet, through a central angle of35038'52" an arc length of279.98 feet;
Thence North 36027'27" East distance of 125.52 feet, to the north line of said Lot 1;
Thence along the said north line, South 53032'33" East a distance of90.00 feet;

of a curve to the left;
