RELEASE AND RECONVEYANCE OF EASEMENT
COMES NOW the City of Bozeman, 411 E. Main, Bozeman, MT 59715, a
Municipal Corporation of the State of Montana hereinafter ("GRANTOR") and does
hereby release and reconvey the following described easement(s) unto Gallatin County,
a political subdivision of the State of Montana, 311 W. Main, Bozeman, MT, 59715, as
follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of the Easement and Right-
of-Way for Water Pipe Line recorded in Book 17, Pages 435-438, Records of the Clerk
& Recorder, Gallatin County, Montana, situated across the Dedicated Park Area of
Hodgeman Canyon Subdivision, Gallatin County, Montana.
WHEREAS the above Easement and Right-of-Way for Water Pipe Line was
granted August 6,1957, and recorded on August 15,1957, at the Clerk and Recorder's
Office of Gallatin County, Montana.
WHEREAS the construction of said Water Pipe Line was not constructed entirely
within said easement recorded on August 15, 1957, and WHEREAS the construction of
a new Water Pipe Line will be constructed within the easement recorded on Document
No. 2185265 , Records of the Clerk & Recorder, Gallatin County, Montana,
vacation of said easement recorded on August 15,1957, will not adversely impact the
Grantor's interests.
WHEREFORE, the Grantor does hereby release and reconvey to Gallatin
County, Montana, said easement recorded on August 15, 1957, together with any right,
title, or interest that the Grantor may have in said easement.
