PUBLIC STREET EASEMENT Valley Center Enterprises, LLC , GRANTOR, in consideration of $ 1.00 and for other and valuable considerations, receipt of which is acknowledged, grants to The City of Bozeman, a municipal corporation of the State of Montana, with offices at 411 East Main, Bozeman, Montana 59715, GRANTEE, its successors and assigns, a perpetual street and utility easement for the use of the public, in, through, and across a strip of land situated in Gallatin County, Montana, to be located on the following described real property: A tract of land beina Lot 2, of Minor Subdivision No. 210, said tract beina located in the NE1/4, Sec. 35, T1S,R5E. The GRANTOR states that he possesses the real property described above and that he has a lawful right to grant an easement thereon. The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted without any interruption by the GRANTOR. The GRANTEE does hereby indemnify and promise to protect, defend, and hold GRANTOR harmless from and against any and all liability, loss, damage, expense, actions, and costs, including costs and reasonable attorney's fees incurred by GRANTOR in defense thereof. asserted or arising on account of or out of any acts or omissions of GRANTEE, GRANTEE's servants, agents, tenants, visitors, guests, invitees, or contractors in exercise of GRANTEE's rights granted hereunder.
