Brian -
I was absolutely shocked to see that the home we used as our base for the remodel/addition
was completely demolished and thrown in a dumpster yesterday. I am currently reviewing
your drawings and reviewing in my mind how I designed your project. I keep coming back to
the same memory: the West, North and East walls of the original bungalow were to remain
intact and the southern third / upper level were to be new construction. This memory can
be verified by studying the Foundation Plan, Main Level Framing Plan and comparing the As-
Built Main Level Floor Plan and newly designed Main Level Floor Plan.
Because we are in a historic district, I attempted to keep as much of the original character
as I could. Also, to keep things easy for you to build (and pay for), I maintained the existing
window and door openings in my new design. Thus, keeping the N/W/E walls was always
part of the plan (I also noticed that you demolished the first floor/framing, not part of the
plan).
I foresee some issues that may arise due to wiping out the entire structure:
1. Now that you are starting from scratch with the framing, you will be held to a higher
standard and all of the construction must meet current codes. We did not have to
design/add lateral hold-downs/shear walls/connections to the Northern 2/3's of the building,
because the original exterior walls in these areas were to remain in place. This can get
increasingly complicated because you do not know what the construction of the foundation
was. Is there adequate reinforcing? Is it designed to take the lateral loads that the new
retro-fitted hold-downs are going to put into the foundation? Are you prepared to tear out
the old foundation and slab and pour new ones?
2. The main level floor framing in the Northern 2/3's was to remain in place. You will need
to have the new floor joists, new center beam, new mid span beam post(s), new footings for
posts (existing slab sawn out and new footing poured) and all the required connections
designed by someone and approved by the City building department. In addition, the new
codes will require anchor bolts at a specific spacing, these will need to be retro-fitted as
well.
3. You said in a phone message to me that Courtney, of the Planning Department) had
verbally approved tearing down the entire building. Did the building department, that issued
the Building Permit, that allows you to do this Work, approve demo of the entire building?
What are they going to use for documents when they come to sign-off on your new
construction?
4. Due to the fact that there is such a large deviation (at least in the Northern 2/3's of the
building) from the stamped/approved drawings, all life/safety issues that may arise over the
lifetime of the new structure are now your liability, This new construction is not following
what Mark Weirich Architect and Matt Anderson, Compass Consulting (now Hyalite
Engineers) stamped.
I am also very surprised to hear that the City Planning Department approved the complete
destruction of a historic home in a historic district. I felt that the only way we got their
approval and our COA, was the fact that we maintained the N/E/W walls, their window /
door location and proportion, and the original exterior materials/finishes.
I am also surprised that I was not consulted on a decision that is going to have such a huge
effect on the eventual end product, your budget and your relationship with your neighbors
(I had one neighbor screaming at me, calling me a *&%#ing @##hole yesterday, because
they knew I did the design for you).
Don't take this letter wrong, I wish no ill will to you or your project. I hope it turns out great
in the end. Like I said, I am just in shock, elimination of this historic building was not my
intent and was never part of the plan.

Section 3303(Demolition)of the 2009 International Building Code(IBC)states that"Construction documents and a
schedule for demolition must be submitted when required by the building official. Where such information is required,
no work shall be done until such construction documents or schedule,or both are approved."
All Dumping and disposal shall be in strict conformance with City of Bozeman Ordinance#10.04,070 and must comply
with all State and County regulations.
City of Bozeman Municipal Ordinance-Section 10.04.080 Permit-Performance bond required when:
Every person,firm or corporation apply for a demolition permit shall file with the city a bond in the sum of
$2,000.00,conditioned that the person,firm or corporation will in good faith perform all work required by
the code&other applicable codes of the city,and shall release,defend,indemnify and hold harmless the
city,its officers,employees,agents and assigns from and against any&all actions,claims,liabilities,demands
or assertions of liability,causes of action,losses,costs&expenses including,but not limited to,reasonable
attorney's fees,involving or relating to any harm,injury or damage,suffered or sustained which in any manner
may arise or be alleged to have arisen,or resulted from the work authorized to be done pursuant to this article.
Such bonds must be filed with the building division.
City of Bozeman Municipal Ordinance-Section 10.04.090 Permit-Surety bond required when:
A. Every person,firm or corporation applying for a demolition permit shall file with the Building Division a
surety bond,in the sum of one hundred twenty-five percent of the contract price issued by an insurance
company authorized to do business in the state,to insure that all work is completed in a proper and safe
manner&in accordance with all the provisions of this chapter. In no case shall the surety bond be less
than$5,000.00.
B. Exception. The provisions of this section shall not apply to single-family residences,garages,out-buildings,
or customary accessory buildings or structures.

Memo to file
On Monday, April 6,the City of Bozeman learned that the historic residence at 402 West Koch Street
was demolished in violation of the zoning and building permits approved by the City in 2014. The
property is located within the City's Neighborhood Conservation Overlay District and the residence
contributed to the Cooper Park Historic District, on the National Register of Historic Places.
On April 8, 2015,the Building Inspection Division received an after-the-fact request for a demolition
permit for the residence. Historic Preservation Officer Kramer signed the demolition permit in order to
obtain the conformance to Sec. 10.04.080 and Sec. 10.04.090 of the Bozeman Municipal Code,which
requires a surety bond to insure that all work is completed in a proper and safe manner. This bond
protects the public's health, safety and welfare on the site.
