Mayor Krauss and Commissioners,thank you for-the opportunity to speak this
evening. My name is Brian Martin and I am the owner of the property at 402 W.
Koch St. As my recent actions have caused public outcry, I thought it important to
come before you this evening and clarify the situation as well as to apologize.
To begin,I want dispel the rumors circulating that my wife Anne and I are careless
bulldozers of historic property. The fact is we do care,and by viewing the approved
blueprints of our proposed and approved project, one can clearly see the attention
taken to recreate a historic design.
To those in shock and disbelief over the destruction of our home, I can appreciate
your reaction given the City's public notice that reads "rehabilitation of the existing
residence",and my building permit that states "interior remodel&addition" The
blueprints approved by the City called for far more than an interior remodel. Rather,
these blueprints clearly and essentially illustrate a tear down with the exception of
three 8' exterior walls,which I will show you in a moment.
First,however,I would like to demonstrate that the new approved structure will in
fact emulate the old.

These drawing demonstrate the original structure and the near complete removal as
approved. It is my belief that given the description of the building permit,public
shock and anger would have prevailed.

This drawing shows the remaining windows that were to be replaced with new
energy efficient units. The approved print called for all new window framing to

include double headers,kings, and trimmers. The shaded area around the window
shows the area disturbed by the necessary engineering. It was our choice to remove

the remaining siding vs.patching in new siding against old creating a Frankenstein
patchwork effort. Additionally, 2012 International Building Code Section 316,
recently adopted by the City of Bozeman calls for an uninterrupted layer of exterior
hard board foam insulation installed between the exterior side of the wall stud and
the siding..-Siding removal and replacement is not a new practice on historical
properties,and can be witnessed on the recently completed restoration by my
neighbor Dr.Jerry Wheelers home on 3ra.

This drawing represents what is left of our home after the siding is removed. Keep
in mind all interior lathe and plaster was also to be removed for insulation. So this
is an accurate representation.
Surface area calculations have been run, and at this point over 80%of the original
building had been approved for removal.
It was only at this point that I should have stopped the deconstruction and consulted
the City about the necessity to move further. I didn't because I was faced with some
unforeseen structural issues that needed to be addressed quickly,and as
incredulous as it may sound, I just didn't think about the need to go back to the City
at that moment.
Facing me was a floor system deemed both unsafe and unfit due to the presence of
mold,rot, and additional structural deficiencies. Given this unsafe condition of the
floor system,I then proceeded to remove the floor, and in the process had to remove
the last remaining wall studs sitting upon it.
With only the foundation remaining,I called another engineer to view the integrity
of the foundation. I even have video of a portion of the west wall being tipped over
by one single fool" Sadly the engineer found the foundation to be severely
compromised in areas and replacement recommended. Certainly it seemed,better
to do it now than after the new home was built on it.
In closing, I ask the Commission and City to consider the facts as presented and take
into careful consideration the importance to my neighbors the timely re-review of E
my original plans for an expeditious return to work on the previously approved
structure. I ask the commission to appoint a person as a point of contact that can
answer the necessary questions I have about set back approval,rescinding of the
stop work order, or other procedural hurdles. I kindly ask that whatever need be
approved by the commission at these public meeting be placed on the docket for
next week.

NOTICE OF AN APPLICATION FOR A
CERTIFICATE OF APPROPRIATENESS APPLICATION WITH A DEVIATION
An application was submitted to the Department of Community Development requesting approval
of a Certificate of Appropriateness with a deviation to enable the following modifications to the existing
residence at 402 West Koch Street: 1) an addition to the rear of the existing residence; 2) rehabilitation of
the existing residence; 3) construction of an accessory garage; and 4) related site improvements. The
property is zoned R-2 (Residential- Medium Density) and located within the Cooper Park Historic District
and the Neighborhood Conservation Overlay District.
The application requests a deviation from Bozeman Municipal Code (BMC) Section 38.08.050
"Yards," to allow portions of the residential addition to be constructed in the required 15 foot
corner-side front yard setback along South 4th Avenue.
The purpose of the review is to consider a Certificate of Appropriateness application with a
deviation for the Martin Addition and New Accessory Garage, requested by property owner Brian
Martin, 402 West Koch Street, Bozeman,MT 59715 pursuant to Chapter 38 of the Bozeman Municipal
Code (BMC).

The property is addressed as 402 West Koch Street and is legally described as the east 50 feet of
lots 1-5 and the north 15 feet of lot 6, block 27 of the Park Addition to the City of Bozeman, Gallatin
County,Montana and is within the boundaries of the Neighborhood Conservation Overlay District.
The City Commission will review the application at a public hearing on Monday,April 14,
2014. The Commission meeting begins at 6pm in the City Commission Room of City Hall, 121
North Rouse Avenue.
The City invites the public to comment in writing and to attend the public hearing. Written
