Resolution 4599 Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Anna Rosenberry, Administrative Services Director SUBJECT: Resolution No 4599 - MAKING MINOR MODIFICATION TO SPECIAL IMPROVEMENT LIGHTING DISTRICT NO. 388 FOR THE ADDITION OF FIVE LIGHT-EMITTING DIODE (LED) STREET LAMPS. MEETING DATE: May 18, 2015 AGENDA ITEM TYPE: Consent RECOMMENDATION: Approve Resolution No. 4599 – Making Minor Modification to Special Improvement Lighting District No. 388 for the Addition of Five LED Streetlamps. BACKGROUND: The Element Hotel project on Mendenhall Streets is required to add a total of 5 streetlamps along Mendenhall Street and Black Avenue. They will be adding LED streetlamps that match the existing downtown streetlamps and poles. Rather than create a new district, we are recommending the lamps be added to the existing district as a minor modification. Minor modifications do not require separate notice to property owners in the district when the modification results in an increase in annual assessments of 3% or less. UNRESOLVED ISSUES: None. ALTERNATIVES: Do not modify the existing district or proceed with the streetlamps; create a new district for the new lamps. FISCAL EFFECTS: The annual electricity costs are estimated to add $140 per year to the District costs. This constitutes an estimated 2.9% increase in annual assessments for property owners. Attachments: Resolution No 4599 Report compiled on: May 12, 2015 79 Page 1 of 2 COMMISSION RESOLUTION NO. 4599 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, MAKING MINOR MODIFICATION TO SPECIAL IMPROVEMENT LIGHTING DISTRICT NO. 388 FOR THE ADDITION OF FIVE LIGHT-EMITTING DIODE (LED) STREET LAMPS. WHEREAS, on the 22nd day of August, of 1956, the Commission adopted Resolution No. 815, Declaring it to be the intention of said Commission to create a Special Improvement Lighting District No 388 for the purpose of operating and maintaining a lighting system to light Mendenhall Street from the East line of North Third Avenue; and, WHEREAS, on the 12th day of September 1956, the Commission heard objections to and, after said hearing, adopted the resolution; and, WHEREAS, since that time, the City has been under contract with Montana Power Company and/or Northwestern Energy to provide power and maintenance of the luminaires in the District; and WHEREAS, the City assesses property owners in the District a total of $4,750 per year for ownership, maintenance, and electricity costs; and WHEREAS, the hotel project located at the corner of Black Avenue and Mendenhall Street is required to install 5 new luminaires for street lighting; and WHEREAS, said luminaires will be located in the District and dedicated to the City of Bozeman; and WHEREAS, said additional luminaires will be metered separately and maintained by the City of Bozeman, without annual ownership and maintenance costs paid to Northwestern Energy. WHEREAS, the annual electricity costs are estimated to add $140 per year to the District. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: The addition of these luminaries to Special Improvement Lighting District No. 388 will benefit the District and shall constitute a minor modification of the District, pursuant to Montana Code Annotated Title 7, Chapter 12, Part 43.
