RELEASE AND RECONVEYANCE OF EASEMENT
::r- COMES NOW the City of Bozeman, a municipal corporation ofthe State of Montana, of 411 East
r Main, P.O. Box 1230, Bozeman, MT 59771-1230, the GRANTOR, does hereby release and
~ reconvey the following described easement to Castlebar II Limited Partnership, a Montana limited

0 partnership, with a mailing address of 413 West Idaho Street, Boise, ID 83702, as follows:

~ WITNESSETH
If)
WHEREAS the GRANTOR is the legal record title holder of Sewer and Water Pipeline and Access
Easement and Agreement situated across Lot 3, Annie Subdivision Phase II, City of Bozeman,
according to the plat thereof, on file and of record in the office of the Clerk and Recorder, Gallatin
County, Montana, and located in the SE 1/4 of Section 2, T. 2 S., R. 5 E. ofP.M.M., which is more
particularly shown and described on Exhibit F, recorded on Film 204, Pages 1367 and 1368, records
of the office of said Clerk and Recorder.
WHEREAS the above mentioned Sewer and Water Pipeline and Access Easement and Agreement
was granted July 7, 1999 and was recorded on Film 204, Pages 1355 through 1368, at said office of
the Clerk and Recorder of Gallatin County, Montana.
WHEREAS the water main that was originally constructed through the easement shown on said
Exhibit F was relocated because it was in the location where a building was to be constructed, and
the water main relocation has been completed along with the building construction, and WHEREAS
a new water main easement has been granted for the new water main location, and the release and
reconveyance ofthe portion ofthe easement shown and described on the attached Exhibit A, which
by this reference is made a part hereof, will not adversely impact the GRANTOR'S interests.
WHEREFORE, the GRANTOR does hereby release and reconvey to Castlebar II Limited
Partnership, a Montana limited partnership, that portion ofthe Sewer and Water Pipeline and Access
Easement and Agreement, as described on said Exhibit A and as shown as the shaded area on said
Exhibit A, together with any right, title or interest that the GRANTOR may have in said property.
This release and reconveyance shall not affect the remainder ofthat Sewer and Water Pipeline and
Access Easement and Agreement dated July 7, 1999 and recorded on Film 204, Pages 1355 through
1368, at said office of the Clerk and Recorder of Gallatin County, Montana.
