Res 4595 Vacuum Truck Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: John Alston- Water/Sewer Operations Superintendent Craig Woolard- Director of Public Works SUBJECT: Authorize Mayor to sign Commission Resolution No. 4595 which allows the City Of Bozeman to sell its 1995 Ford L800 Vac Con Sewer Flusher/Vacuum truck in the amount of $15,000 to the Town Of Manhattan. MEETING DATE: May 11, 2015 AGENDA ITEM TYPE: Consent RECOMMENDATION: That the Commission Authorize the Mayor to sign Commission Resolution which allows the City Of Bozeman to sell its 1995 Ford Vac Con Sewer Flusher truck in the amount of $15,000 to the Town of Manhattan. BACKGROUND: The Sewer Department has recently purchased a new Sewer/Vacuum truck for which the Department has no need for its 1995 Ford Vac Con Sewer Flusher/Vacuum truck. The Town of Manhattan has indicated a need for this truck and its purchase from the City without an ordinance, public auction, bids or appraisal is allowed under Section7-8-101(2) Montana Code Annotated. The Department has sold its Aries TV van to Threes Forks and a Sewer Flusher truck to MSU under this section. UNRESOLVED ISSUES: None. ALTERNATIVES: None. FISCAL EFFECTS: The $15,000 will be placed into the WasteWater Operations budget. Attachments: Commission Resolution No. 4595 Report compiled on: April 28, 2015 115 COMMISSION RESOLUTION NO. 4595 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO SELL A CERTAIN SURPLUS ITEM FROM THE WASTEWATER DEPARTMENT TO A COUNTY OR OTHER POLITICAL SUBDIVISION WITHIN THE STATE OF MONTANA. WHEREAS, the City of Bozeman has acquired a new replacement sewer flusher/vacuum truck; and WHEREAS, the City of Bozeman no longer has a need for the old sewer flusher/vacuum truck; and WHEREAS, Section 7-8-101(2), Montana Code Annotated, grants the City of Bozeman the power to dispose of any property which is not necessary for the conduct of the City business to any county or other political subdivision without an ordinance, public auction, bids or appraisal. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 That it is hereby declared to be in the best interests of the City of Bozeman to dispose of the 1995 Ford L800 Vac-Con Sewer Flusher/Vacuum truck, VIN No. 1FDZW82D3SVA74480 to the Town of Manhattan, a political subdivision of the State of Montana, for the purchase price of $15,000, which is equal to the truck’s trade-in value. The Town of Manhattan has agreed to pay the City of Bozeman $15,000 upon delivery of the truck. Section 2 That, pursuant to Section 7-1-4127, M.C.A., the Clerk of the Commission shall cause notice to be published in the Bozeman Daily Chronicle at least once a week for three (3) successive weeks, which notice shall be to the effect that such Resolution has been duly and legally passed and further expressing the City’s intent to dispose of the item listed in Section 1, in the manner described herein. 116 PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular session thereof held on the 12th day of November, 2002. _________________________________________ JEFFREY K.
