SUBJECT: Authorize the City Manager to sign a Right of Way Agreement, Public
Drainage Easement Agreement, Public Utility and Access Easement, Public Drainage Easement, and Temporary Construction Permit with the J&D Family Limited Partnership.

RECOMMENDATION: Authorize the City Manager to sign a Right of Way Agreement,
Public Drainage Easement Agreement, Public Utility and Access Easement, Public Drainage
Easement, and Temporary Construction Permit with the J&D Family Limited Partnership.
BACKGROUND: On April 13, 2015 the City Commission authorized additional street impact
fee expenditures for the Cottonwood Road project to provide for its construction from Alpha
Drive to Fallon Street. The project impacts property commonly known as the J.C. Billion Auto
Dealership which is owned by the J&D Family Limited Partnership. Compensation for impacts
has been negotiated with Mr. Joe Billion, general manager of the partnership, and agreed as provided in the attached Right of Way Agreement, Public Drainage Easement Agreement, and
Temporary Construction Permit. The rate of compensation on a $/sq. ft. basis was determined by
a property appraisal completed by Joki & Associates in July 2014 in accordance with standard
appraisal practices for commercial real estate. The compensation was calculated by multiplying
the impacted area of property by the appraised rate.
Compensation is provided for a Public Utility and Access Easement as memorialized in the Right
of Agreement at a total amount of $35,063.50. This easement will provide for public access and
utilities from Cottonwood Road to Auto Plaza Drive as shown on the exhibit provided with the
easement. The access design onto Cottonwood Road provides for full turning movements and aligns with the existing access on the east side of the road shared by First Security Bank and
Alpine Orthopedic.
Compensation is provided for a Public Drainage Easement as memorialized in the Public
Drainage Easement Agreement at a total amount of $28,068.00. The easement will contain a stormwater detention pond sized to handle runoff from full principal arterial roadway section in
accordance with City engineering design standards.

Compensation is provided for a Temporary Construction Permit at a total amount of $2,647.20.
The construction permit allows for the use of a strip of land of varying width on Mr. Billion’s
property to facilitate the roadway construction.
ALTERNATIVES: As suggested by the Commission.
FISCAL EFFECTS: The current FY’15 budget contains $100,000 in the Street Impact Fee CIP
for ‘right of way acquisition’. Total compensation to Mr. Billion amounts to $65,778.70. The cost to obtain the property appraisals is borne by the City as well, at a total fee of $8,000. The
total cost for the Cottonwood Road project to the right of way acquisition line item in the
approved street impact fee CIP is $73,778.70. There is a sufficient balance in the street impact
fee CIP to cover this expense.
